First Amendment Fight: CEI’s Climate Change Subpoena

The latest effort in an intimidation campaign to criminalize speech and research on the climate debate was launched by a coalition called “AGs United for Clean Power” and landed on the Competitive Enterprise Institute’s doorstep on April 7, 2016. That day CEI received a subpoena from Attorney General Claude E. Walker of the U.S. Virgin Islands that attempted to unearth a decade of the organization’s communications, emails, statements, drafts, and other documents regarding CEI’s work on climate change and energy policy, including private donor information. It demanded that CEI produce these materials from 1997-2006, nearly 20 years ago. 

The battle over the CEI subpoena followed:......Wednesday, June 29: Walker announced that he was withdrawing his Exxon subpoena.  Thursday, June 30: Walker announced he was withdrawing his Virgin Islands CEI subpoena.  We immediately informed the court of these developments, pointing out that the withdrawal of the Exxon subpoena was seriously at odds with what his attorney had told the court at the hearing.  What’s next?
