My Take - This is clearly a violation of the separation of powers. It's the President's job to make these decisions - that's the law and intent of the Constitution. The legislature can weigh in on this by passing laws, and the President can affirm that law or veto it. The Congress can then override his veto if they can muster the votes. But this absolutely is not - not - the responsibility of unelected judges of the federal judiciary - most of whom are nothing by political hacks in the first place. Just like this judge.
They talk about how he bases his decisions one whether or not it helps people. A laudable viewpoint - if your a private citizen, a philanthropist, a legislator or the President. That's not the job of anyone in the judiciary. He needs to be sent back into civilian life, where as an attorney he can do all the darn good he pleases - with his views, with his time and his money.
