If you’re not sure you can beat him, then disqualify him. Indeed, the
latest gambit by the left in their addled state of Trump derangement is
to weaponize the so-called insurrection clause in the Constitution’s
14th Amendment to wipe Donald Trump off the ballot. And it comes as
polls show Trump paradoxically gaining strength every time his enemies
figure out another novel legal theory by which they can arrest him for
criminal conduct – and now leading in a majority of recent polls. A
group of citizens in Colorado, backed by an ethics watchdog group, are
the latest to erupt with a frenzied initiative asserting that Trump must
not be allowed to appear on the 2024 presidential ballot in the Rocky
Mountain State – and several other states ruled by Democrats appear set
to make the same case. A trip all the way up the ladder to the US
Supreme Court appears inevitable.
While we are keenly aware of the lengths to which Trump’s
enemies will go to take him down, this latest initiative to employ the
Constitution in service of canceling the most popular Republican in the
country is most confusing. That’s because it comes after we’ve been
hearing for months on end about a very different grand plan cooked up by
Democrats for vanquishing
their mortal enemy. They once believed that arresting him – four times
to date, each time applying the law as never before – in order to stoke a
conservative backlash would lead to his nomination – and then, viewing
him as the most vulnerable Republican, they would defeat him in
November.
To Trump or Not to Trump
So, which is it? Do the
Dems still want to all but force Republicans to back the 45th
president? Or do they want him off the ballot?
Well, it now
appears they are not sure, and are in a state of panic because their
grand plan is not just failing – it has produced the opposite
of the desired effect: the growing perception that the transparently
political nature of the 91 charges leveled against Trump is overkill,
crying wolf, and most importantly, is making them look more corrupt than
the man they are constantly arresting. And for those who stubbornly
argue that the four indictments are from varying jurisdictions, and
therefore not coordinated by the White House, the timing of the federal
trial on January 6-related charges should remove any last shred of
doubt. The Obama-appointed judge has set the trial to begin the day before Super Tuesday,
the pinnacle of the presidential primary season. Apparently, the left
no longer even cares how nakedly political their use of banana
republic-style police power to silence and disqualify their political
enemy appears to the populace.
A
year after the start of WWI, President Woodrow Wilson addressed his
message to Congress and warned that the “gravest threats against our
national peace and safety” did not come from “other governments”, but
from “within our own borders”.
“Citizens of the United States,”
Wilson continued, “born under other flags but welcomed under our
generous naturalization laws to the full freedom and opportunity of
America, who have poured the poison of disloyalty into the very arteries
of our national life.”
Wilson, a notorious racist and a
supporter of the KKK who had contempt for a wide variety of other
peoples, likely had German immigrants, but not just them, in mind when he called for what would become the Espionage Act so that “we may be purged of their corrupt distempers.”
“I need not suggest the terms in which they may be dealt with,” Wilson concluded.
While
there were indeed pro-German terrorist conspiracies in those days,
including the Black Tom bombing which damaged the Statue of Liberty and a
plot to infect the country’s horses, the Espionage Act of 1917 went far
beyond prosecuting criminal activities. Wilson had sought, but not
received, the power to censor the press, he did get the power to censor
the mail.
Most of those prosecuted under the Espionage Act were
not terrorists, but political opponents of the war. They included
leftist socialists like Charles Schenck whose Supreme Court case birthed
the misleading cliche about “shouting fire in a crowded theater”, as
well as Robert Goldstein, a filmmaker whose crime was making a movie,
‘The Spirit of ’76’, about the American Revolution.
Also
prosecuted under the Espionage Act were members of the Watch Tower
Society for their religious pacifism. This was described as almost “the
only time in American history when almost all the leaders of a
denomination were in jail”.
When former President Trump was
indicted under the Espionage Act, he was being targeted by a law that
from its very inception had been created to suppress the political
opposition. While elements of the Espionage Act were watered down over
the years and only media hacks still quote “shouting fire in a crowded
theater” as if it were standing law, that hasn’t really changed.
Widely
loathed by liberals and leftists, who were justly often the targets of
it, the Espionage Act was mostly used against actual spies during the
Cold War. That changed dramatically under Obama who dusted it off and
used it to go after reporters and whistleblowers. A decade ago, the
Obama administration used the Espionage Act to target FOX News reporter
James Rosen.
The Espionage Act allowed Obama to use warrantless
wiretapping to bust leakers who were in many cases acting as
whistleblowers and trying to expose his administration’s misconduct.
The
abuse of the Espionage Act against reporters foreshadowed Russiagate.
Having realized how useful the package of national security tools could
be against political opponents in the press, the Obama administration
decided to go ahead and use them against Trump.
When Obama and
Clinton associates in the Justice Department targeted Gen. Flynn for
conducting preemptive diplomacy for the incoming Trump administration,
they explored using the Espionage Act and the Logan Act. The current
charges against Trump are not an unexpected development, they’re what
Russiagate was always about.
Power corrupts. And once the Obama
administration realized that it could use the Espionage Act to kill
unfavorable stories in the media, it was obvious that its members would
not stop until they had escalated to using it directly against political
opponents from Gen. Flynn to Trump.
Leftists used to hate the
Espionage Act, like all forms of government power, until they were able
to take control of it. And then, instead of being targeted by it, they
wielded it and, with the inevitably corrupt predictability of human
nature, used it to settle political disputes.
There are any
number of parallels between Woodrow Wilson and Joe Biden. Both men were
parochial narcissistic racists who ran as moderates only to rule as
radicals. And their public profiles seemed so absurd that their
opponents had a bad habit of underestimating them.
In a
foreshadowing of what could happen to Biden, Wilson became
non-functional in office and the country was temporarily run by his
wife, yet he went on dreaming of a third term in office.
Wilson, like Biden, might have also been thinking of using the Espionage Act to cover up his own corruption.
For
nearly a decade, Wilson had been conducting a secret affair with
another woman. Fearful of discovery, he sent her thousands of dollars, a
fortune by today’s standards, and drafted a partial admission of guilt.
Wilson had called for the Espionage Act earlier that year which would
give his administration the authority to censor the mail. It would have
been a convenient means of suppressing revelations about his affair that
might have damaged his reelection campaign.
Fortunately for
Wilson, former President Theodore Roosevelt, his 1914 election opponent,
had dismissed the idea of exposing the affair. “No evidence could ever
make the American people believe that a man like Woodrow Wilson, cast so
perfectly as the apothecary’s clerk, could ever play Romeo,” Roosevelt,
a barrel-chested man of action, had sneered.
By 1916,
Republicans, stuck with the uninspiring candidacy of Charles Evans
Hughes, appeared ready to take off the gloves and were trying to
aggressively get hold of Wilson’s letters. The version of the Espionage
Act that allowed Wilson to censor the mails, but not the press, may have
been a compromise to protect the use of the ‘nuclear option’ of the
affair.
Biden, likely unknowingly, followed in Wilson’s footsteps
by deploying claims of foreign election interference to suppress the
Hunter Biden laptop story during the election.
The abuse of
national security by Democrats to go after the political opposition is
not a new phenomenon. It’s been underway for over a century with the
Espionage Act.
Charging Trump under the Espionage Act is no
accident: it’s a proud tradition. It’s also a deeply corrupt and illegal
attack on the Constitution. But that’s the function that the Espionage
Act has served for over a century under Democrats. Corrupt
megalomaniacal Democrats like Wilson, Obama and Biden use claims of
national security to illegally investigate their opponents.
And
whether it’s Wilson’s affair with a married woman, Hunter Biden’s harem
of Uber prostitutes, or Joe Biden’s money from China, the Espionage Act
is a red flag for presidential corruption.
National security is
legitimate when it protects Americans from foreign enemies, not when
it’s used, as Wilson and Biden have, to target Americans under the
facade of national security.

problems. That’s exactly the situation that people put themselves in
when they
rely on Amazon or Google Home to control their smart home only to
realize that they no longer control their home. A touchy corporation
that celebrates Pride Month and BLM all year round does. Beware of offending it..................
As I read this I couldn't help but think of the infamous
Pavlik Morozov: Soviet Boy Hero, who denounced his father to the Soviet authorities, who eventually killed him. If you research this story you will find there's a lot of confusion as to what really went on, but, let's go with it because this we know for sure. He was used as a tool for Soviet propaganda as the example for all Soviet youth to rat out their friends and family. The only difference is now mechanical devices are listening on our conversations and reporting, to of all things, a corporation. One that's taken on the mantel of judge, jury and executioner.

When
Barack Obama announced that he was unilaterally legalizing millions of
illegal aliens while further opening the border, he described it as
using “discretion about whom to prosecute”.
In the years since, pro-crime prosecutors have virtually dismantled the justice system in some jurisdictions by using their “discretion” not
to prosecute thieves, drug dealers and violent criminals. Some
prosecutors announced that they wouldn’t prosecute rioters and looters,
others that they would stop prosecuting prostitution, public urination
or thefts of under $1,000.
In the decade since Obama announced
his exercise in prosecutorial discretion, the country has been overrun
with criminals and illegal aliens who benefited from that “discretion”.
But prosecutorial discretion, like most leftist policies, works both ways.
Manhattan DA Alvin Bragg issued a
‘zero day’ memo on taking office that told prosecutors not to seek
prison sentences for armed robbers. Bragg then labored to indict former
President Trump while bypassing such niceties as the statute of
limitations and the actual nature of the crime.
Such
prosecutorial discretion has become routine in New York where Attorney
General Letita James has championed criminal justice reform while
targeting not only Trump, but the NRA. Bragg’s predecessor, DA Cyrus Vance,
gave Jeffrey Epstein and Harvey Weinstein a pass. He announced that he
wouldn’t charge former Mayor Bill de Blasio, but pursued Trump. After
refusing to charge BLM rioters or prostitutes, he made a point of
dragging a woman featured in a viral video into court because she had
called the police during a dispute with a black man.
But it’s also become normal at the federal level.
Hillary
Clinton and her aides mishandled classified information on a massive
scale. The indictment of President Trump contrasts sharply with the
treatment of Hillary, not to mention Biden who left classified documents
lying around his garbage. The Trump team will argue selective
prosecution, but the prosecution will argue that it can charge whom it
pleases.
And to some degree this is true. Prosecutors have no
obligation to charge Bob if they charge Jack. And Jack’s lawyers will
rarely even bother bringing up Bob in court unless he’s white. Most of
the major selective prosecution cases have relied on racial
discrimination and so, like most civil rights laws, they leave out the
political discrimination that has become the leading civil rights issue
of our time. Prosecutors don’t target black people, they do target
Republicans.
Prosecutorial discretion is meant to allow
prosecutors to bring their strongest cases. Instead, beginning with
Obama, it has created a two-tier justice system in which some forms of
crimes, despite their destructive impact on society, get a pass while
others that have minimal impact, are overcharged for purely political
reasons. Even offenses that are very similar are treated very
differently based on the political identity of the prosecutor and of the
defendant.
And that has made for two sets of laws: written and unwritten laws.
Written
laws matter very little. Whether a written law is enforced is subject
to the discretion and therefore the political agenda of the prosecutor.
That’s no longer a function of individual judgment, but political
alignment. Billionaire leftists like George Soros and Netflix boss Reed
Hastings have spent a fortune electing prosecutors that meet their
needs. A movement of political prosecutors has vowed to enforce, or not
enforce laws, for political reasons.
What matters are not the
written laws, but the unwritten ones of politics. Justice takes a
backseat to social justice. Criminals who clearly violate written laws
are not charged by the same prosecutors who indict political opponents
for process crimes or laboriously invent crimes.
“Show me the man
and I will find the crime,” Andrey Vyshinsky, Stalin’s prosecutor, had
reportedly boasted. Prone to speeches in which he declared that, “our
entire country, from small to old, is waiting and demanding one thing:
traitors and spies who sold our Motherland to the enemy, to be shot like
filthy dogs” and “down with these abject animals, let’s put an end once
and for all to these miserable hybrids of foxes and pigs, these
stinking corpses, let’s exterminate the mad dogs of capitalism, who want
to tear to pieces the flower of our new Soviet nation”, he dominated
the show trials of the Great Terror with political posturing.
Justice
depends on written laws. The Great Terror discarded, invented and
casually misapplied laws. As did its counterparts in Nazi Germany. The
unwritten law of the regime mattered more than the written law. And in
America, the unwritten law has come to matter more than the written. The
only law that truly matters is upholding the political agenda of those
in power and histrionics and theatrics are used in place of a rigorous
adherence to the written law.
Vyshinsky warned of an urgent
threat to Marxism and the Soviet nation, his modern counterparts clamor
that they are averting urgent threats to democracy on the one hand and
systemic racism on the other. The written law has failed and they
replace it with their unwritten laws to meet the manufactured
emergencies that they have created for just this purpose.
The
fundamental principle of the civil rights movement was that justice was
no substitute for equal justice. Political prosecutorial discretion
eliminates equal justice and replaces the law with an agenda. There can
be no equality and no justice if prosecutors pick and choose whom to
charge based on their politics. Even when their charges are grounded in
the legality of individual cases, the systemic double standard
eliminates the legality of those charges.
Only the consistent
application of the law serves as an instrument of justice. The legally
inconsistent, but politically consistent application of the law is
simply tyranny under the color of law. It is no more justice than only
handing out parking tickets to Democrats or Republicans. It would matter
very little whether the tickets were individually justified because
they would still be expressions of political repression, not an honest
enforcement of parking regulations.
Nothing undermines respect
for the law and trust in the legal system faster than when people
observe that they have become corrupt tools for the repression of
political opponents.
When Democrats freely defy subpoenas while
Republicans are arrested, when mishandling classified information is
only a crime for one party, when rioting isn’t a crime, but defending
yourself is, there is no law, only a totalitarian regime selectively
exploiting some laws.
The Left demands discretion for judges and
prosecutors to set aside the law for social justice. And then, when they
set aside the law for leftists and selectively throw the book at
conservatives, also in their discretion, we become a nation of men, not
laws.
A nation of laws, not men, does not allow prosecutors or judges to place their will above the law.
Prosecutors
who refuse to enforce the law consistently should be removed, impeached
or charged. There is no room for Vyshinskys or a two-tier justice
system in our nation.
Until we have one set of laws for all, not two, there will be no justice in America.
One thing is clear, this indictment of Donald Trump is nothing more than a Soviet style system of political intimidation, tyranny, and a precursor to more of the same, and worse. It was clear the Libby case was in reality an effort to "get" then VP Chaney. Then the Senator Stevens case, and how the DOJ helped get Obamacare passed in that case. The Mar-A-Lago raid was and example of DOJ corruption, and "the House Judiciary Committee has detailed the

Trump’s situation is precarious, but his fate isn’t necessarily sealed.

But what are the long term consequences of this unprecedented and corrupt practice? These corrupt usurpers of justice are playing with fire. They've sown the wind and they're going to reap the whirlwind if they don't succeed. They're now in a situation they must now impose tyranny to survive. I'll come back to that.

Now we come to my reaping the whirlwind comment. Now a precedent has been set. Going after a former President is just fine and dandy, even if no crime has been committed. And that's the rub isn't. Biden has been deep into criminal activity for many years. The "Big Guy" has been taking bribes to take positions on policy that are not in America's best interests, and even if they were, taking a bribe is a crime!
We keep hearing hypocrites like Comey intoning, "no one is above the law", and that's going to come back to haunt them. All this corruption of the rule of law is backfiring on Biden and his misfit crew. Polls show Trump is more popular than ever, meaning America knows this is nothing but tyrannous corruption be the Deep State. If Trump is re-elected make no mistake, he will appoint a mad dog in a meat market for his Attorney General. If, or when that happens, Biden, Hunter, the Clintons, Comey and that entire host of corrupt members of the Obama administration, even many at the FBI, DOJ, CIA, and NSA are going to have to face federal prosecutors for their criminal activity and it may even include Obama, because "no one is above the law", and his history is at best shady.
