In Roanoke, Virginia, Wasil Farooqui had attacked a couple with a knife while shouting, “Allahu Akbar”. His targets, a Muslim man and his non-Muslim girlfriend, had been swimming in the pool and were behaving immorally by Islamic standards. The Pakistani attacker had recently traveled to Turkey and was suspected of trying to join ISIS. His male victim had been cut “all over his body, including his neck.”

Wasil’s lawyer fought hard to keep jurors from hearing about the “Allahu Akbar” part of the attack because it would play on stereotypes. He brought in a professor to testify that, “Allahu Akbar” is used to “express praise or appreciation.” But the judge made his decision and jurors will hear the grim sound of Allahu Akbar in the courtroom just as Wasil’s victims did.

The defense in this case, as in almost every other Muslim terror case, is mental illness. Wasil had been “hearing voices”. Since a homicidal maniac hearing voices is how Islam was founded, that’s not much of a defense against accusations of Islamic terrorism. If antipsychotics had existed in the 7th century, ISIS, Al Qaeda, Hamas and the everyday horrors that tourists have encountered this August would not exist.

August isn’t quite over yet, but there’s been quite a few expressions of praise and appreciation this month sung in the same key as the pool hating Pakistani living on the Great Indian Warpath.

Just this weekend, a Muslim from Luton drove up to Buckingham Palace. Her Majesty’s unwilling subject might have been looking for the Queen, but she was over at Balmoral Castle in Scotland. When the police came to have a word with him, he reached for a 4 foot sword and shouted, “Allahu Akbar”. The Bobbies, traditionally unarmed, maced him. He managed to cut up their hands before being arrested.

Earlier, a Somali in Brussels had expressed some praise and appreciation by stabbing Belgian soldiers while shouting, “Allahu Akbar”. They belatedly shot him dead. A Koran was found in his possession.

It’s hard to think of any European events that could better have validated the mayor of Venice’s declaration that anyone shouting, “Allahu Akbar” in St. Mark’s Square would be shot by snipers.

But it’s been a fairly busy Allahu Akbaring August.

Early in August, the Eiffel Tower had to be shut down after a Mauritanian Muslim effusively expressed his appreciation to Allah by waving a knife and shouting that he wanted to kill a French soldier for ISIS.

The authorities claimed that he had psychiatric problems.

Parisian tourist attractions have been special targets of Islamic praise and appreciation. Back in February, an Egyptian Muslim with a machete shut down the Louvre while shouting, “Allahu Akbar”.

Some extremely unappreciative French soldiers shot him.

But at least French Christians and Jews appreciated the break from Allah’s interfaith blades.

Last year, Muslim attackers shouting Allahu Akbar had slit an 84-year-old priest’s throat and a Turkish Muslim teenager had attacked a Rabbi carrying a Torah with a machete while shouting, “Allahu Akbar”.

But this year, a Muslim broke into the apartment of an elderly Orthodox Jewish nursery school director, beat her and then threw her out the window. He shouted anti-Semitic slurs, recited portions of the Koran and shouted, “Allahu Akbar”. Previously he had visited a Jihadist mosque.

So of course the authorities blamed mental illness.

Finland got its first official terrorist attack in August as a Moroccan Muslim refugee shouting, “Allahu Akbar” began stabbing women. The Muslim migrant came to Finland after trying his luck in Germany. His rampage claimed the lives of two women and wounded six women and two men trying to help.

The slaughter appears to be another of Merkel’s presents inflicted on the rest of Europe. It might be Germany’s best gift to Finland since the Lapland War.

The reign of terror in Spain that began with a van attack in Barcelona ended when Younes Abouyaaquob, the driver of the van, was hunted down by police. He yelled, “Allahu Akbar” before he was shot. His five mates in nearby Cambrils had also been shouting, “Allahu Akbar” before police nailed them.

It had been a bloody Allah August in Spain. The terror cell had killed 16 people and wounded over 100. But this terror season in Spain had actually started early in late July when a knife-wielding Muslim, stop me if you’ve heard this one before, attacked a police officer while shouting, “Allahu Akbar.”

After several months of bloody Allahu Akbaring in the UK, the dog days of summer were quieter. At least until a Muslim with a 4-foot sword showed up at Buckingham Palace. Taha Hussain, who had developed the unappreciated habit of driving around the street while shouting, “Allahu Akbar” was found guilty.

In these trying times, no one really wants to hear that sort of thing in their neighborhood.

In Germany, the authorities decided that a man who shouted, “Allahu Akbar” while stabbing people at a train station in Munich last year was just mentally ill and not a terrorist. Meanwhile shortly beforehand, a Muslim refugee had stabbed seven people in a Hamburg supermarket while shouting, you’ll never guess what. One of the supermarket stabber’s victims died. The authorities claim he was mentally ill.

Closer to home, at the start of August, some 400 miles from Wasil’s stalking grounds, a Nashville man named Kaden began shouting, “Allahu Akbar” at a Kroger’s while claiming that he had a bomb. Just as in the case of the Barcelona van driver, there was no bomb. Back in June, a Tunisian Muslim had walked over to an airport police officer and shouted, “Allahu Akbar” before stabbing him in the neck.

But that’s the way it goes. Sometimes August is hotter than usual. Other times it’s cooler. Sometimes the Allahu Akbar stabbings flare up in London and other times in Paris. But like the weather, Islamic terrorism is always there. If it’s not happening where you live, then it’s erupting somewhere else.

Back in Roanoke, once the trial gets properly underway, jurors will be allowed to consider whether Wasil Farooqui’s yell of “Allahu Akbar” indicated that he was a terrorist or just expressing praise and appreciation while stabbing two people who had committed the crime of going swimming.

And, like all the Allahu Akbar stabbers in Germany and France, it’s just madness. The madness that causes the mad dogs of the Jihad to foam at the mouth and leap at infidel throats in the dog days of August. The madness of a mad prophet who commanded his followers to kill all the black dogs before he got around to ordering the ethnic cleansing of the Christians and Jews of Arabia.

August is usually hot. But when the Allahu Akbar shouters come around, it’s best to stay out of the water. If, like Queen Elizabeth, you can retreat to a castle, you should do so. If you can’t, be careful on the sidewalks of resort towns and in cafes. Walk carefully in London and Paris. Stay on guard at the Louvre, Buckingham Palace, London Bridge and the Eiffel Tower. And if you hear a shout of, “Allahu Akbar”, better hope that you’re in St. Mark’s Square and that there are trusty snipers watching.

And if you can get through a European vacation without hearing, “Allahu Akbar”, then thank God.

We are still a great people. The rescuers remind us of that. But we lack the culture or the politics to reflect that greatness. The noble impulses that lead men to risk their lives in flooding are there. But our society no longer has the vessels to hold and sustain those impulses.

The media doesn't quite know what to make of the rescuers. You can see the itching to return to the stories that it knows and likes. Russia. Trump hit pieces. People punching each other in the street over politics. It swerves at the first sight of a Confederate flag on a rescue boat or Ted Cruz's Sandy vote. It doesn't want to dwell on the best of us. Behavior like that doesn't make sense anymore.

Generations have grown up with leftist protesters as their definition of heroes. Look in a history book and the last 70 years consisted of "heroes" who marched around waving signs until they got everything they wanted. And everyday in the news there are more "heroes" marching for illegal aliens, transgender bathrooms, the supremacy of black lives and any other identity politics cause.

But waving a placard to the adulation of the media isn't heroism. Saving lives is.

Our culture has quickly forgotten that less than two decades ago, men carrying half their weight climbed to the top of the World Trade Center to save lives. They died there.

The America of a hundred or even fifty years ago, would have immortalized them. Ours drowned them out in tantrums, in whines, in anger and outrage, in malicious noise.

They were a dangerous reminder that we were a great people. And our destroyers desperately wanted us to forget. They wanted us to sink to the bottom. Not to rise to the moment.

The secret of so much of our greatness was simply that we tried. We took our best and we made it the cultural norm. Every people tell themselves that they are wonderful and destined to rule the world. The Germans and the Russians believed it and it led them to ruin. But we told each other that we were decent and we became decent. We told our children that the moon could be theirs. And it was.

We told them that we could cure diseases. And we did. That we would prevail over the atom bomb. And we did. That we would change the world. And we did.

But more importantly, we told them about sportsmanship. We told them to stand up for principles. To take pride in hard work. To believe in the future. To tell the truth. To help old ladies across the street. To tie knots well. To sacrifice for family. To see themselves as heroes, however unlikely.

We made all of those things into a culture. That was the secret. Anyone could have done it. You just had to believe.

And that culture has been slowly dying. Some days it looks almost dead.

Our culture and politics exist to give us permission to lie in the mud. That has become their unhidden purpose. Decency is a dead language. Shock value is our entertainment. Contempt and outrage are our national discourse. The Chinese build cities and islands. We yell at each other over the Internet.

It's hard to remember a time when writing the Great American Novel was an ambition. The American novel is dead. Literature, like art, has become segmented into high brow garbage and low brow garbage. The aspirational middle brow culture is dead.

The movie theater is filled with billion dollar adaptations of comic books, Disney rides and cartoons. The handful of teens who can be pried away from their phones long enough to watch something they'll forget five minutes later aren't even the target audience. America is a stopover territory on the way to the real markets in the teeming cities of China.

How does a culture like that deal with heroism? It can't. It doesn't have the vocabulary for it.

We can still marvel at it. But it's not enough to be impressed by good men and women doing the right thing. Cultures that succeed don't just marvel, they preserve it and pass it on. They build dams around virtue. They harness it and plug in the next generation.

We wonder why the Iraqis or Afghans can't stop killing each other. We explain democracy to them, but it's as meaningless as trying to teach a goat how to paint. But behaviors have to be embodied in a cultural language. Otherwise it's just so much noise.

Civilization is written in the language of values. That language tells us how to behave and how to live. Without that language, we're savages. And savages are not that hard to find all around us. And when you spend enough time around savages, you begin to go native.

When doing the right thing isn't rewarded, few will do it. If everyone cheats, then not only will everyone cheat, but the idea of honestly doing the right thing will become a strange and meaningless thing. If principles don't pay, why have them. If decency is dying, why be decent.  If everyone cheats, cheat. If everyone steals, steal. If everyone lies, lie. Anyone who doesn't is weak and worthless.

Heroism is the beacon in the night. It inspires and shocks us. It reminds us of what we can be.

Men and women risking their lives for others is not such a rare thing even in our latter days. Men and women who are honest and decent are not all that rare either. But they are rare in our culture. They exist, but our culture has no room for them. The meaning of their lives isn't written into our culture. And so the moment passes and as a dog returns to its vomit, our culture returns to its vomit.

The extraordinary moment passes. But it doesn't need to it.

Everyone dies. Heroes, victims and villains all perish. But some values live on in a culture. And that is our choice. We can be a great people. But at the very least, we must remember that we are.

 

Greek Government’s Moral Bankruptcy on Soviet Terror Generates Strong Response from Estonia

I like the Baltic nations, as illustrated by what I wrote last year.

I’m a big fan of…Estonia, Latvia, and Lithuania. These three countries emerged from the collapse of the Soviet Empire and they have taken advantage of their independence to become successful market-driven economies. One key to their relative success is tax policy. All three nations have flat taxes. And the Baltic nations all deserve great praise for cutting the burden of government spending in response to the global financial crisis/great recession (an approach that produced much better results than the Keynesian policies and/or tax hikes that were imposed in many other countries).

No wonder the Baltic nations are doing a good job of achieving economic convergence.
I’ve specifically praised Estonia on several occasions.

Estonia’s system is so good (particularly its approach to business taxation) that the Tax Foundation ranks it as the best in the OECD. …Estonia…may be my favorite Baltic nation if for no other reason than the humiliation it caused for Paul Krugman.

Indeed, I strongly recommend this TV program that explored the country’s improbable success. And here’s some data showing that Estonia is leading the Baltics in convergence.

Now I have a new reason to admire Estonia. Having experienced the brutality of both fascism and communism, they have little tolerance for those who make excuses for totalitarianism. And the issue has become newsworthy since Greece decided to boycott a ceremony to remember the victims of communism and fascism.

Estonian Minister of Justice Urmas Reinsalu responded to his Greek counterpart, Stavros Kontonis following the uproar caused by the decision by Greece to not participate in the recent European Day of Remembrance for Victims of Stalinism and Nazism in Estonia.

The letter sent by Reinsalu is a masterpiece of moral clarity. He unambiguously condemns all ideologies that are contrary to free societies. Let’s look at some excerpts.

Our values are human rights, democracy and the rule of low, to which I see no alternative. This is why I am opposed to any ideology or any political movement that negates these values or which treads upon them once it has assumed power. In this regard there is no difference between Nazism, Fascism or Communism.

Amen. That’s basically what I wrote just a few days ago.

Reinsalu points out that free societies (sometimes called liberal democracies, with “liberal” used in the “classical liberal” sense) don’t oppress people, which is inherent with fascist and communist regimes.

Condemnation of crimes against humanity must be particularly important for us as ministers of justice whose task it is to uphold law and justice. …Every person, irrespective of his or her skin colour, national or ethnic origin, occupation or socio-economic status, has the right to live in dignity within the framework of a democratic state based on the rule of law. All dictatorships – be they Nazi, Fascist or Communist – have robbed millions of their own citizens but also citizens of conquered states and subjugated peoples.

The Estonian Justice Minister refers to the bitter experience of his nation.

Unlike Greece, Estonia has the experience of living under two occupations, under two totalitarian dictatorships. …In light of the experience of my country and people, I strongly dispute your claim that Communism also had positive aspects. ……in 1949, …the communist regime deported nearly 2 percent of the population of Estonia only because they as individual farmers refused to go along with the Communist agricultural experiment and join a collective farm. This was in addition to the tens of thousands who had already been imprisoned in the Gulag prison camps or deported and exiled earlier. Thousands more would follow, taken into prison up to mid-1950.

He points out that communism is incompatible with freedom.

…it is not possible to build freedom, democracy and the rule of law on the foundation of Communist ideology. …this has been attempted… This has always culminated in economic disaster and the gradual destruction of the rule of law…there are also countries and peoples for whom the price of a lesson in Communism has been millions of human lives.

The bottom line, he writes, is that all forms of totalitarianism should be summarily rejected.

…we must condemn all attempts or actions that incite others to destroy peoples or societal groups…there is no need to differentiate. It makes no difference to a victim if he is murdered in the name of a better future for the Aryan race or because he belongs to a social class that has no place in a Communist society. We must remember all of the victims of all totalitarian and authoritarian dictatorships.

Kudos for Minister Reinsalu. He doesn’t shrink from telling the truth about communism and other forms of dictatorship.

None of this should be interpreted to mean that western societies are perfect. Heck, I spend most of my time criticizing bad policy in the United States and other western nations. But there’s no moral equivalence.

My Take - Greece is a mess that's unfixable and is unlikely to be an independent country within the next 25 years, and they won't be alone in that regard among the EU nations. 

Greek Life retreat cancelled after banana peel found in tree

A Greek Life retreat at the University of Mississippi (Ole Miss) was promptly cancelled this weekend after a banana peel was found hanging in a tree. A student said he threw the peel because he could not find a garbage can, but the incident made some students uneasy, so the school “felt it was imperative to provide space immediately to students affected by this incident.”

My Take - A banana peel was found in a tree and academia Greek life was crushed?  Really? If there ever was an example of how academia needs cleansed - this it.  If their goal is to turn out cry babies who have to hide in "safe places" everytime something "offends" them - and the list of things that seem to offend them grows incrementally - then they've become a completely successful enterprise.

If their goal was to turn out real men and women prepared to face the real world's trials and tribulations - then they're an abysmal failure.  It's time we stopped financing higher education and make them all become for profit institutions recognizing they've now become viper's pits of social disintegration.

Here's a reminder.  The media is nothing more than the communications department of the Democrats and the left. Whatever reporting they do is only a vehicle for shamelessly injecting their narrative into every single story.  CBS, MSNBC and CNN, among others, have been pushing the line of attack that President Trump is visiting Texas too soon. And that his visit will disrupt rescue and recovery efforts. CONFIRMED: Comey Decided He Wasn't Going to Refer Hillary for Prosecution Long Before FBI Investigation Was Over

"According to the unredacted portions of the transcripts, it appears that in April or early May of 2016, Mr. Comey had already decided he would issue a statement exonerating Secretary Clinton. That was long before FBI agents finished their work. Mr. Comey even circulated an early draft statement to select members of senior FBI leadership. The outcome of an investigation should not be prejudged while FBI agents are still hard at work trying to gather the facts," the letter, signed by Chairman Chuck Grassley and Committee member Lindsey Graham states. "Conclusion first, fact-gathering second—that's no way to run an investigation. The FBI should be held to a higher standard than that, especially in a matter of such great public interest and controversy."

"It is unclear whether the FBI agents actually investigating the case were aware that Mr. Comey had already decided on the investigation's outcome while their work was ongoing. Wilkinson Solar wants to catch the solar wave, and make bundles of money sending electricity to the grid whenever it’s generated, even if it’s not needed at the time. The company’s proposed 288,120 solar panels would blanket 600 acres of now scenic farmland next to a school near the North Carolina coast. The project carries lessons for the rest of America – and all locales considering solar.

Locals are not happy. The electricity would be exported out of the area, which has been hit by Category 3 and 4 hurricanes and multiple tropical storms over the years. Another big one would likely send glass shards flying all over. Meanwhile, the Tar Heel state averages just 213 sunny days per year and 9 hours of bright sun per day; that translates into electricity just 20% of the year – unpredictably, unreliably, less affordably. Carbon dioxide reduction benefits? None. These and other issues must get a full hearing, before regulators issue any approvals.

Yet another renewable energy boondoggle

Wilkinson Solar has filed papers requesting permits for a 74-megawatt solar electricity facility about 35 miles east of Greenville, NC. If approved, 288,120 solar panels would blanket 600 acres (0.94 square miles) of now scenic, serene farmland next door to the Terra Ceia Christian School near Morehead City.

The company wants to catch the solar wave, and make a lot of money under “net metering” policies that require payment for electricity added to the grid, whenever it is generated and regardless of whether the electricity is needed at the time. Electricity generated from these new panels would not be sold in the local area; it would be exported to Virginia, Raleigh-Durham and other locations.

Solar power installations doubled in 2016 over 2015, media outlets reported in February. There are now 1.3 million solar installations across the United States, with a cumulative capacity of over 40 gigawatts. That’s enough capacity to power 6,560,000 US households, they say. Of course, there are caveats.

There was intense effort to install as much new photovoltaic as possible in 2016 – driven by a fear that federal tax credits would not be renewed. Solar actually rose from 0.96% of US generation in 2015 only to 1.37% in 2016. 65% of electricity generation is still fossil fuels, 20% is nuclear, 6.5% hydroelectric, 2.0% biomass and geothermal, and 5.6% wind (which is as unreliable as solar).

The reliability factor is critical. The capacity to power 6,560,000 households does not equal actual power generation. It is what panels can generate if the sun shines at high enough intensity 24/7/365. It can be a lot of the time in areas that are bright, dry and sunny most of the year – to very little in other regions.

Those and related issues must guide decisions on whether the Wilkinson facility makes energy, engineering, economic and environmental sense for this North Carolina community, the Tar Heel State – or other locales facing similar decisions. Solar may be advantageous for politicians, corporations, renewable energy activists and their allies. But that should not override other considerations.

A 600-MW capacity coal, gas or nuclear plant operates 90-95% of the time. Its actual output will thus be 540 to 570 megawatts – from 300 acres (or less): 1.8 to 1.9 MW per acre, reliably and affordably.

Wilkinson would theoretically generate 74 MW from twice as much land. That’s 0.12 MW per acre – or 8.1 acres per MW. However, North Carolina averages only 213 sunny days per year, and perhaps 9 hours of good, electricity-generating sun per day.

Instead of 90-95% efficiency, Wilkinson would bring only 20% efficiency. The 288,120 panels would produce electricity only about 20% of the year. That is unpredictable, unreliable, less affordable energy.

The real output would be around 0.03 MW per acre or 33 acres per MW! Wilkinson’s claimed ability to generate enough electricity for 12,500 households shrinks to 2,750 homes, when the sun shines.

Wilkinson and farmers turned occasional power producers would still reap large sums of cash, via net metering and feed-in tariff policies. But crop and wildlife habitat lands would be converted to massive solar arrays, while neighbors would get a blighted landscape and no monetary or other benefits.

As Solar Mania and Solar Sprawl spread, electricity consumers would see their rates climb: from the 9 cents per kilowatt-hour average they now pay in North Carolina and Virginia, ever closer to the 16 to 18 cents per kWh that residents pay in “green energy” states like Connecticut, New York and California. Families, hospitals, schools, businesses, farms and factories would face increasingly tougher times paying their electric bills. Poor and minority families would be hit hardest.

Then there’s the survivability issue. Since 1879, North Carolina has been hit by twelve Category 3 hurricanes, one Category 4 (Hazel in 1954) and multiple tropical storms. Imagine the shards of flying glass that would be torn from solar panels and sent flying in all directions when the next ’cane inevitably hits. What that would do to people, animals and property is not pretty to contemplate. Torrential rains brought by these storms would send flood waters roaring through the installation, wreaking further havoc.

Solar proponents always tout energy, employment and climate stabilization benefits – which don’t exist.

Every megawatt of solar power must be backed up by coal or natural gas generators. Otherwise we have electricity when it happens to be available, instead of when we need it. Otherwise our offices, hospitals, assembly lines, televisions and internet go on and off constantly. No one can work or live that way.

The backup power plants must be running on standby (spinning reserve) all the time – then must ramp up to full power every time the sun stops shining. That slashes their efficiency, and sends their fuel costs and emissions skyrocketing. Any supposed energy, sustainability and climate benefits disappear.

Moreover, it is highly unlikely that any solar array can ever generate enough electricity over its entire life span to equal the energy that went into making, installing and servicing the panels. Mining the raw materials, turning them into metals and other panel components, hauling and installing the panels – all require enormous amounts of motor fuels, coking coal and electricity. The balance sheet is in the red.

Add in what it takes to build, fuel and operate the backup power plants, and solar is bankrupt.

Solar power does create jobs. In fact, U.S. Department of Energy data reveal that producing the same amount of electricity requires one coal worker or two natural gas workers – but 12 wind industry employees or 79 solar workers. That is hardly the ticket to a productive economy.

Even worse, Spanish and other studies have found that, for every renewable energy job created, two to four jobs are lost in other sectors that are forced to pay more and more for less reliable electricity.

Price and reliability are crucial in our digital age, with electricity the key to modern living standards, health, safety, and almost everything we make, eat and do. Solar electricity makes prices rise and reliability decline; its repeated electrical surges and slumps damage grid stability.

Some say using fossil fuels – which provide 82% of the energy that makes modern civilization possible – causes dangerous manmade climate change. But Hurricane Harvey just ended the nearly 12-year record absence of a Category 3-5 hurricane striking the United States. Average planetary temperatures are back to the same level we’ve seen for almost 20 years, following the end of the 2015-16 El Niño.

Those and other inconvenient realities completely contradict decades of alarmist climate predictions. And as just noted, overall fossil fuel use and carbon dioxide emissions increase as solar power proliferates.

All this underscores why we must build more pipelines from areas that have become major natural gas production regions, thanks to hydraulic fracturing. Whether a gas-fired power plant serves as a primary electricity generator, or as backup for wind and solar, new pipelines are essential. They determine whether families, hospitals and businesses have affordable electricity when they need it.

Unfortunately, an array of governors, mayors, legislators, regulators and activist pressure groups are blocking pipeline projects from the Dakotas to New York and beyond, even as they promote more wind and solar. Pipelines and electricity are the backbone of our economy, civilization, jobs and living standards. Cut or paralyze that backbone, and our society will cease to function.

Hearing officials must give local residents and energy experts opportunities to explain these issues and voice their concerns about energy, land use, job, economic, environmental, hurricane and other impacts from solar installations like Wilkinson. Anything less is a dereliction of duty that benefits a few players – at the expense of everyone else. That must no longer happen.

It's Time For a Twenty Eighth Amendment!

Editor's Note: I originally published this on Friday, June 26, 2015, but with current events I've decided to publish this again. And I've decided to run this at least once a year.

Yesterday Mark J. Fitzgibbons penned this article, Sotomayor's 4th Amendment Time Bomb regarding “A painfully slim 5 – 4 ruling this week by the Supreme Court in City of Los Angeles v. Patel”. He writes, “The court struck down a Los Angeles ordinance that allowed police officers to inspect hotel guest registries for any or even no reason, and without a warrant. The ruling that the Fourth Amendment applies to businesses and that statutes may be declared unconstitutional on their face is consistent with principles as old as, and even older than, the Constitution.” But he also notes that “Justice Sonya Sotomayor’s majority opinion is also a blueprint for a major power grab for the administrative police state” because “her majority opinion even seems to suggest that police departments may be given power to approve their own searches using administrative subpoenas instead of going to judges to obtain warrants”.

Administrative subpoenas? Is she serious? This isn’t something that should even be an option!   The article goes on to explain why say it’s Constitutionally inappropriate for administrative subpoenas to be issued by federal bureaucrats saying, “Justice Frank Murphy’s short but powerful and prescient dissent from his all-Democrat appointed colleagues is spot on”:

"I am unable to approve the use of nonjudicial subpoenas issued by administrative agents. Administrative law has increased greatly in the past few years, and seems destined to be augmented even further in the future. But attending this growth should be a new and broader sense of responsibility on the part of administrative agencies and officials.

Excessive use or abuse of authority can not only destroy man's instinct for liberty, but will eventually undo the administrative processes themselves. Our history is not without a precedent of a successful revolt against a ruler who "sent hither swarms of officers to harass our people."

Perhaps we are too far removed from the experiences of the past to appreciate fully the consequences that may result from an irresponsible though well meaning use of the subpoena power.

To allow a nonjudicial officer, unarmed with judicial process, to demand the books and papers of an individual is an open invitation to abuse of that power. It is no answer that the individual may refuse to produce the material demanded. Many persons have yielded solely because of the air of authority with which the demand is made, a demand that cannot be enforced without subsequent judicial aid. Many invasions of private rights thus occur without the restraining hand of the judiciary ever intervening.

Only by confining the subpoena power exclusively to the judiciary can there be any insurance against this corrosion of liberty. Statutory enforcement would not thereby be made impossible. Indeed, it would be made easier. A people's desire to cooperate with the enforcement of a statute is in direct proportion to the respect for individual rights shown in the enforcement process.

Liberty is too priceless to be forfeited through the zeal of an administrative agent."

Does Sotomayor, who actually described herself as the “wise Latina”, really understand that?

The founding fathers created lifetime appointments for federal judges because they wanted them to be unafraid about losing their jobs for unpopular decisions. There were some differences between then and now. First of all there were few federal judges and nowhere in the Constitution does it outline exactly their duties. Originally the Supreme Court handled very common cases. Their authority developed over time and they pretty much created their own parameters of responsibility.

Secondly the federal government was amazingly small compared to today and everyone pretty much thought it would stay that way. However the passage of the 16th amendment (income tax) and 17th Amendment (popular elections of Senators) pretty much laid the foundation destroying the checks and balances between the branches of government and the vision of a limited central government, which the founding fathers believed was essential to individual liberty. They couldn't have been more right.

Although it’s true judges can be removed by impeachment. It’s also true the federal judiciary is filled with political hacks that have made decisions that can’t be construed as anything but high crimes. The high crimes of the Constitution means a “crime of high office”,which can simply mean they’ve failed to perform the duties they have sworn by oath to perform. It’s clear the federal judiciary no longer believe they have to "solemnly swear (or affirm)they will administer justice……under the Constitution and laws of the United States." They’re clearly not following the Constitution, and they clearly don’t believe they need to “preserve and defend the Constitution against all enemies foreign and domestic” since they are Constitution’s greatest enemy. If that’s so – and it is – and it’s so obvious – and it is – why aren’t more judges impeached? Because getting a two thirds majority to vote for conviction from the Senate is almost impossible.

As historian Dr. Clarence Carson wrote: "Jefferson doubted that the fear of impeachment was little more than a paper tiger, or as he put it frequently in private correspondence, “not even a scarecrow.” He put the danger this way: “We already see the power, installed for life, advancing with a noiseless and steady pace to the great object of consolidation. [“The engine of consolidation,” he had said, “will be the federal judiciary . . . .”] The foundations are already deeply laid by their decisions for the annihilation of constitutional state rights, and the removal of every check, every counterpoise to the engulfing power of which themselves are to make a sovereign part.”

Has this occurred? It should be obvious to the most casual observer that it has and the Supreme Court’s recent decision King v. Burwell is a clear example the federal judiciary has become an out of control law unto themselves. Justice Scalia’s scathing dissent is a simple, direct and easy to understand intellectual tour-de-force demonstrating how far they’ve sunk in their efforts to overturn the balance of power created by the Constitution.

Scalia states:  “We should start calling this law SCOTUScare ……the cases will publish forever the discouraging truth that the Supreme Court of the United States favors some laws over others, and is prepared to do whatever it takes to uphold and assist its favorites…

He went on to say: “Words no longer have meaning …..Under all the usual rules of interpretation, in short, the Government should lose this case. But normal rules of interpretation seem always to yield to the overriding principle of the present Court: The Affordable Care Act must be saved……

He observes: The Court tries to palm off the pertinent statutory phrase as “inartful drafting.’ This Court, however, has no free-floating power ‘to rescue Congress from its drafting errors.’”…..“The Court’s decision reflects the philosophy that judges should endure whatever interpretive distortions it takes in order to correct a supposed flaw in the statutory machinery. That philosophy ignores the American people’s decision to give Congress ‘[a]ll legislative Powers’ enumerated in the Constitution. They made Congress, not this Court, responsible for both making laws and mending them.”…..

Demonstrating just how dangerous the federal judiciary has become: “More importantly, the Court forgets that ours is a government of laws and not of men. That means we are governed by the terms of our laws, not by the unenacted will of our lawmakers. ‘If Congress enacted into law something different from what it intended, then it should amend the statute to conform to its intent.’ In the meantime, this Court ‘has no roving license … to disregard clear language simply on the view that … Congress ‘must have intended’something broader.”…

He states what should be the understanding of all federal jurists: “Rather than rewriting the law under the pretense of interpreting it, the Court should have left it to Congress to decide what to do about the Act’s limitation of tax credits to state Exchanges.”

If the Constitution is going to really be the document that governs government, and is the real and legitimate law of the land, it's in serious need of reinforcements. It’s time for a 28th Amendment that would impose strict term and age limits on the federal judiciary.

There are three levels of the federal judiciary- the District level, the Appeals level and the Supreme Court. Each level should have a ten year limit with a review after five years requiring a majority approval by the Senate. At each level each nominee would have to go through the same process, even if nominated to a higher court before they finish their term in a lower court. If their tem runs out and they’re not nominated to a higher court they may be nominated at some point in the future. No jurist can return to a lower court if their term runs its course at a higher level, and no jurist can ever be appointed to a court if their nomination to any court has ever been rejected by the Senate. No jurist may serve after the age of seventy.

Here’s the fix! Abolish the FED, repealing the 16th and 17th Amendments and pass a 28th amendment. Everything else will fall into place.

Oh, one more thing.

Some judges are determined to strike down election integrity laws, no matter what.  How else can you explain last week’s irrational decision handed down by federal District Court Judge Nelva Gonzales Ramos? A President Barack Obama appointee, Ramos is at least consistent. This was the fifth time she has rejected a voter ID law for Texas.   Her 2014 rebuff of the original version of the Texas law made it clear that she believes all voter ID laws are based solely on the desire to discriminate, not improve the integrity of the election process.

Now you know why the plaintiffs went shopping to her federal court to bring the statewide challenge.

In 2014, Ramos ruled that the law discriminated against minority voters—ignoring clear evidence that this is not the case. Minority turnout had actually increased in the 2013 state election, the first election held with the new ID law in place.  What makes Ramos’ latest ruling so odd is that the amended law not only followed all guidelines set out by the 5th Circuit Court of Appeals, it also contained provisions that Ramos herself had found acceptable as an interim remedy for the November 2016 election......To Read More....

Angela Merkel Says She Wouldn’t Change the Way She Handled the Refugee Crisis

Angela Merkel has said she has no qualms about her decision to open Germany’s doors to refugees in 2015, arguing that the policy was “humane” and a reaction to an emergency situation.  German Chancellor said she was convinced that she had made the right decision to allow safe passage – for which she took a political hit in Germany and which appears to have driven the rise of the right-wing populist AfD party.

My Take - One of the things that becomes apparent for those who follow leftists, along with their policies is - the left has some real difficulties with truth, history and consistency - except in one area.  The left is consistently stupid.  What is shocking is how stupid are the German people when it's clear she's going to be returned to her leadership role as Chancellor.   She's literally destroying German society and they like her.

Well, there's an economic downturn on the horizon and when that happens - we're going to see civil wars all over Europe, the EU will cease to exist, and the current multicultural socialists will be replaced with nationalist socialist, and bloodshed will be what ushers in that change.
