It's Time For Serious Judicial Reform

By Rich Kozlovich

In today's edition of P&D I've featured a number of articles that demonstrate the absolute need for serious judicial reform in America, for the local judges, and most importantly, the federal judiciary.

Let's start with Andrea Widburg's It’s time for Congress to rein in the federal judiciary noting:

One of Governor Ron DeSantis’s most admirable initiatives as Florida governor has been to lead the movement protecting kids from people and entities sexually grooming and medically mutilating them. Having lost at the legislature, leftists promptly fled to the federal court system. And sure enough, Robert Hinkle, a Clinton appointee in the U.S. District Court for the Northern District of Florida, answered the leftist call and blocked portions of the law against medically mutilating children. His judicial overreach reminds us that an eventual Republican-led government must rein in the federal judiciary.

Briefly, Florida passed a law protecting children from so-called “gender-affirming care” achieved via toxic chemicals (sterilization, fragile bones, cancer, heart disease) and monstrous surgery. (For the latter, a very NSFW image explains what I mean.) Judge Hinkle promptly ruled as a finding of fact that “gender identity is real” and said that these “treatments” for children were too important to ban.  Florida’s battle with a judge who just nullified its law protecting children from medical mutilation perfectly exemplifies dangerous judicial overreach.

Dangerous overreach isn't the exception, it's the rule with the federal judiciary.  Please take note of this pattern of what can only be considered a violation of the separation of powers.  It' s not the judiciary's job to decide social issues, that's the job of the legislature, but this judge disagrees, and in fact believes he has the power to overturn an entire category of federal law dealing with immigration, which clearly falls under the purview of the legislature.   Obama Judge Says 14th Amendment Gives Muslim Migrants the Right to Invade America.  It appears now all immigration laws are unconstitutional, because this nitwit says they're unconstitutional.  Where did he get that understanding?  The 14th Amendment.

Now that's really an incredible stretch of the imagination, which clearly goes way beyond the intent of that post Civil War Amendment.  An Amendment that needs to be repealed as the conditions by which it was passed no longer exist, but can be twisted by minds that are twisted, including Joe Biden's as he used it as a threat claiming he could raise the debt limit under that Amendment without Congressional approval.  A clear violation of the Constitution, and the separation of powers that gives the House of Representatives control of the purse.  This out of control judge openly and angrily attacked the attorneys opposing this view.

Then we have this piece, Colorado Bans Controversial Court-Ordered Reunification Camps.  These judges are out of control and worse yet, they're lazy and intellectually corrupt.  Their job, along with law enforcement, is to be shepherds protecting the flock, and especially the lives of the weak, helpless and innocent, and children absolutely fall into that category.  But what they're doing is in effect becoming enablers to wolves who are destroying the flock.  What's wrong with these people?

Finally we have the case out of my own state of Ohio, by Andrea Widburg, who is one of my favorite writers.  A criminal case out of Ohio shows how far down the crazy road America has gone, saying:

"Judge David McNamee cleared Glines after agreeing that the size of "her" belly meant it would be impossible for anyone to see "her penis".  So according to this judge it's okay for this guy, who claims to be a woman....with a penis.....is permitted to infest the women's locker room because he's fat, and the fact he's assaulted a woman in the past is meaningless."

You really have to personally wonder about this judge?  Would he want his wife or daughters, if he has any, to be exposed to this?   This judge is a DeWine appointee, and must run for and win election in 2023 to keep the seat for the remainder of the unexpired term ending on Dec. 31, 2025.  He's coming up for election this year.  For my Ohio readers, please forward this to your nets.

At least at the state level these misfits can be voted out of office, but that's  not true of the federal judiciary which has lifetime appointments, which was the Founding Fathers greatest mistake, as the federal judiciary is filled with political hacks, and that's been true for decades, which I outline in my article The Federal Judiciary is Filled With Political Hacks saying:

On July 5th, 2020 Henry P. Wickham, Jr. published this piece, Watergate and the Corruption of the DC Judiciary, filled with interesting insights from two books, Geoff Shepard's book, The Real Watergate Scandal and the just published book by Garrett Graff, Watergate, a New History.  I've decided to break this piece down into sections.  The first dealt with John Dean and this next section deals with the federal judiciary, and Judge Sirica............  The author concludes with this statement: Among many lessons, Watergate shows us how power can corrupt and how investigations and legal processes can be abused. This is just what we saw with the case of Michael Flynn, among many others, post 2016, and as we now see with the selective and politically motivated prosecutions by the Biden Justice Department; Attorney General, Merritt Garland being every bit the light weight, political hack that John Sirica was. America is in crisis.

For those who followed the Congressional hearings dealing with Biden's appointees to the federal bench it's clear the left has placed extreme and incompetent radicals on the bench, for the rest of their lives.  As Senator Kennedy noted these nitwits aren't qualified to sit on a park bench let alone have a seat on a federal judicial bench.

It's time for a Constitutional Amendment for age and term limits for the federal judiciary because America is facing an existential Constitutional crisis. A crisis of cultural suicide promoted by a corrupt administration, a corrupt legislature and a corrupt judiciary.
