Update on State Voter ID Laws

This reveals some glaring inadequacies...

By John Droz, Jr, October 21, 2025 @ Critically Thinking About Select Societal Issues

This is an excerpt from a recent Ballotpedia Daily Brew post.

To me, one of the most concerning takeaways is that after 250 years, we still have fourteen (14) States that continue to require zero identification for an individual who wants to vote! What could go wrong with that?

BTW, just like K-12 education matters, this is another example where “leaving things up to the States” is not any assurance of getting quality results.

————————————————————————————————————————

As November nears and voters head to the polls in 36 states, let’s review which states require voters to present identification when casting their ballots — and see where voter ID laws have changed in 2025.

Across the U.S., 36 states require voters to present identification to vote at the polls on Election Day. Of those states, 24 require voters to present photo identification, while the other 12 states accept other identification that does not contain a photograph. The remaining 14 states do not require voters to present identification to vote at the polls on Election Day, in most cases.

Ten states have amended their voter ID laws so far in 2025. One state, West Virginia, moved from requiring non-photo identification to vote to requiring photo identification.

Valid forms of identification differ by state. Commonly accepted forms of ID include driver’s licenses, state-issued identification cards, and military identification cards.

Some states requiring voters to provide identification may have exceptions allowing some people to cast a ballot without providing an ID. For instance, 15 states allow some or all voters to sign an affidavit attesting to their identity at the polls instead of presenting identification. Seven states allow another voter or an election official to vouch for the person’s identity in at least some cases. Four states allow voters who live and vote in state-licensed nursing homes or residential care facilities to vote without showing identification.

Three states — Alabama, New Hampshire, and Kentucky — require voters to provide a copy of their identification when requesting an absentee/mail-in ballot. Two states, Arkansas and North Carolina, require voters to provide a copy of their identification when returning an absentee/mail-in ballot.
Across the country, 10 states passed 10 bills related to voter ID for in-person voting or absentee/mail-in voting during 2025 legislative sessions. Some noteworthy laws states adopted this year include:

  • Colorado SB 1 expanded the list of eligible forms of non-photo identification to include identification and cards issued by the Bureau of Indian Affairs, the Indian Health Service, or any other federal agency that includes an address in the state. Colorado has a Democratic trifecta.
  • Georgia HB 296 required that driver’s licenses used as identification for voting purposes be in a physical format and issued by the Georgia Department of Driver Services. Georgia has a Republican trifecta.
  • Montana SB 276 expanded the list of eligible forms of identification to include a student ID card issued by a school in the Montana university system or a Montana school that is a member of the National Association of Intercollegiate Athletics. Montana has a Republican trifecta.
  • New Hampshire SB 287 required voters to include a copy of their identification or a notarized signature when requesting an absentee ballot by mail or to present their ID to an election official when requesting an absentee ballot in person. New Hampshire has a Republican trifecta.
  • Utah HB 300 required voters to provide the last four digits of their driver’s license, ID card, or Social Security number when returning a mail-in ballot, starting on Nov. 5, 2025. Until Dec. 31, 2028, election officials will attempt to match the voter’s signature on the envelope affidavit to the signature on file for voters who do not provide an identification number. Starting on Jan. 1, 2029, voters must provide the last four digits of an identification number or include a copy of an acceptable ID when returning their mail ballot. Utah has a Republican trifecta.
  • West Virginia HB 3016 required photo identification to vote, though driver’s licenses issued without a photograph remain valid for voting. The bill removed documents from the list of eligible forms of identification and allowed voters 65 years of age and older to use an expired ID if the document was valid when they turned 65. West Virginia has a Republican trifecta.

In addition, Wisconsin voters in April approved a constitutional amendment adding language requiring a photo ID to vote in the Wisconsin Constitution. The amendment allows the state legislature to define what qualifies as a valid photo ID and provide exceptions to the requirement. Wisconsin passed a statutory voter ID law in 2011. On Nov. 4, Maine voters will decide on a ballot measure that would make multiple changes to the state’s election laws, including changes to photo IDs.

Five states adopted five laws related to voter ID in 2024. Thirteen states adopted 14 such laws in 2023. Nine states adopted 10 such laws in 2022.

Election Integrity Going Forward

We've made good progress in the last four years

The worst development of the 2024 Presidential election, would be if pro-American citizens believe that we now have the election integrity issue under control, so that we can “rest on our laurels” — i.e., relax and forget about that concern.

—> THAT WOULD BE A CATASTROPHICALLY BAD CONCLUSION!!!!!

There were less (NOT none!) shenanigans in the 2024 election due to an extensive four year effort by thousands of citizens working hard to fix the numerous holes that exist in our election system. My rough estimate is that we’ve done about 40% of the job.

There are still major changes needed to be done by both States and the Federal Government. A primary objective of Federal regulations should be to standardize election requirements. To have 50 sets of rules for Federal elections is absurd.

It is child’s play to advance partisan election requirements. The objective of these recommendations is to bridge the currently expansive gap between Democrat and Republican proposals, as it’s imperative that we negotiate a middle ground that meets the pro-American objectives of both sides.

This list was put together by a team of independent experts, who volunteered their time to advance the cause of US election integrity. To date, they have generated multiple reports on that nationally important subject.

The items on this list are explained in more detail in Part 3 of their Election Integrity Recommendations Report:

  1. Election laws and regulations may not be changed within 120 days prior to that election.

  2. Primary elections will be closed.

  3. All votes, regardless of voting method, will comply with equal standards.

  4. There will be 1+ week advance in-person voting, at convenient locations for every precinct.

  5. Absentee voting will be allowed only in very specialized circumstances.

  6. All absentee ballots must be received by Election Day.

  7. Drop Boxes are prohibited.

  8. Ballot harvesting is prohibited.

  9. It is illegal for the state, county, or precinct to accept third-party election-related funds.

  10. The state will provide appropriate voter assistance where needed.

  11. Some type of legal ID is required when voting.

  12. It is illegal to have any ballot-related equipment accessible from the Internet.

  13. USPS will be fixed so that all ballots are delivered promptly and properly.

  14. Election day voting will end at 7 PM, local time.

  15. All absentee and early-voting ballots will be tabulated, and reported, first.

  16. Legal election observers will be allowed complete access to the election process.

  17. Fixing deficient ballots (or mail-in envelopes) will be restricted and must be fully transparent.

  18. All counties will be required to report their election results in a standardized format (e.g., CSV).

  19. Sample forensic audits will be required.

  20. Chain of custody must be maintained for all ballots for at least 22 months.

  21. Negative vote tabulations (e.g., to Edison) must have detailed transparent supporting data.

  22. All eligible US citizens will be automatically registered to vote.

  23. All states will be required to annually update their election rolls.

  24. Rules prohibiting non-citizens from voting will be tightened.

  25. A website and an 800 number will be set up for citizens to report possible improper election actions.

  26. National uniform requirements for state vote certification will be established.

  27. Citizens and state legislatures will have legal standing to file in-state election-related lawsuits.

  28. States will seriously consider eliminating Electronic Voting Machines.

  29. State recall rules (if and when a recall is allowed) must be consistent with state election rules.

  30. A bi-partisan Federal commission will be created in 2025 to research and issue a public report on the voting rules and regulations of European Countries, Canada, Mexico, and Australia.

The Bottom Line -

It’s more than disconcerting that there is no continuity in all fifty states, on ANY of the above items! How does that make any sense?

The US House GOP legislators are planning on new election integrity legislation. I will be submitting this to them. Please post any suggestions to improve on any of the above recommendations, in the comments below.

Critically Thinking about the Upcoming 2024 Election The American Experiment is at Stake

By John Droz jr. Oct 07, 2024 @ Critically Thinking About Select Societal Issues

In a democratic country’s elections, most of the emphasis should be on comparing the policies of Candidate A, to the policies of Candidate B. In the US, that idea has apparently gone the way of the buggy whip. We are now immersed in so much subterfuge (some quite sophisticated) that we need to periodically step back to appreciate the magnitude (and origins) of it — and then apply Critical Thinking. Here is my outline of just some of the current lowlights:

1- Zero Progress on Post-Election Audits —

Despite an extraordinary amount of well-documented evidence (e.g., here), plus the indisputable logic of doing it, there is not any US precinct, county, or State where a meaningful post-election audit is mandated! This is a testament to the power of the anti-Americans claiming that such audits: “are not necessary,” “will suppress the vote,” etc., etc. This is unmitigated baloney whose sole purpose is to hide election fraud.

2- Government Invasion of the Private Residence of a Candidate —

In an unprecedented attack on civil rights, the US Government invaded the home of a Presidential candidate. The explanation given was without merit, as the other Presidential candidate was equally (if not more) guilty of the same “offense” (having confidential papers in their residence) — and he experienced no such violation of his rights. Clearly, the main reason for this intrusion was politics: to damage the image of a particular Presidential candidate (e.g., see here).

3- Lawsuits Against a Candidate —

In an audacious assault on civil rights, Democrat prosecutors brought charges against one Presidential candidate. The nature of such charges (and how the deck was rigged at every turn), makes Russian politics look amateurish. As of today, there has not been a final adjudication that he is guilty of anything — but that was never the objective. Once again, the main purpose was to sling mud at a Presidential candidate, knowing that the media would amplify it, and hoping that there were a sufficient number of non-critical-thinking voters that the election would be swayed. (It's good that you noticed the political temerity here, as the root claim was that the prosecuted candidate was “trying to influence the elections” — exactly what they were doing!! )

4- Assassination Attempts Against a Candidate —

In an extraordinarily disturbing development, a Presidential candidate is subjected to two assassination attempts. The Dems claim no responsibility although: a) their incessant and inflamed rhetoric is specifically designed to generate hate and fear of this candidate, and b) the Dem-controlled government agency charged with protecting all Presidential candidates, acted in a woefully incompetent manner.

5- Flooding the Country with Foreign Nationals —

In another beyond-the-pale development, the Dems purposely allowed ten to twenty million undocumented foreign nationals into the country. (See here for a further discussion of this extraordinary, Dem-created catastrophe.) The number of these people who vote in the 2024 election will never be known! (See #1, Audits, above.)

6- Falsely Enflaming the Issue of Women’s Rights —

As they believe that it is a favorable election issue, the Dems have presented themselves as a “champion of women’s rights.” (See a further discussion here.) Once again they hope that voters are not critical thinkers, and will not notice the total hypocrisy of their position. For example, the Dems are also the champions against women’s rights when it comes to biological males competing in women’s sports.

7- Greasing the Skids for President Joe Biden —

The Dem’s process for selecting their Presidential candidate was not some democratic choice by registered Democrats! It was carefully choreographed so that one — and only one — candidate would be victorious: Joe Biden. Other legitimate Democrat contenders (e.g., Robert F. Kennedy, jr) were blocked. So the puppet masters got exactly what they wanted: Joe Biden as the official Dem Presidential candidate.

8- A Last-Minute Presidential Candidate that No One Voted For —

Oops, it soon became apparent that the puppet master’s candidate had no chance of winning — so back to the drawing board! In another unprecedented maneuver, the behind-the-scenes power brokers anointed Kamala Harris as the new “official” Dem Presidential candidate — even though she had not received a single primary vote from even one registered Democrat citizen. The Venezuelan dictator gives them a thumbs-up!

9- Mainstream Media’s Relentless Misinformation —

Journalism used to be a proud and worthy profession, where good people provided the public with objective, factual information that helped them make informed decisions on important democracy-related matters such as elections. Mainstream media abandoned this model decades ago and is now an unabashed promoter of undeclared agendas — mostly anti-American, Marxist agendas. Their survival depends on their being inattentive, non-Critical-Thinking citizens. Essentially every mainstream media story about the 2024 Presidential election, is a serious distortion.

10- Leveraging the Hurricane Disaster —

North Carolina is a pivotal state in the 2024 Presidential election. It is a red-leaning state, so is a target of Dems. The recent hurricane has put the ballots of some 1.3 million NC citizens at risk. Who are they? Per the NC State Board of Elections, there are approximately: 300k Democrats + 500k Republicans + 500k Independents. This appears to be one of the unadvertised reasons why the Federal and State governments are slow-walking NC recovery efforts. If citizens are consumed with day-to-day survival matters, voting will be a low priority, and that will hurt many GOP candidates. (See here.)

-- Takeaway --

When we stand back to see the Big Picture, this should be extraordinarily disturbing. This is NOT how America is supposed to work. Instead: 1) unelected deep state power-brokers are determining who is elected, by hook or by crook, and 2) our K-12 education system is now specifically designed to produce propagandized, non-Critical-Thinking graduates — who soon become voters. These are the people who the Left is counting on, to vote themselves into permanent servitude.

The remaining Critical Thinkers had better: a) speak firmly and clearly to their misinformed fellow citizens, b) support and vote for reform candidates like Michele Morrow, and c) get meaningful post-election audits implemented in their State.

We ALL need to pray that we survive the imminent cataclysmic crisis…

A Proposed Federal Election Integrity Law

This is WAY overdue!

John Droz jr. Feb12, 2024 @ Critically Thinking About Select Societal Issues

I’m well aware that states have the primary authority regarding election matters, but there are certain apolitical, across-the-board regulations that the Federal Government should — MUST — enact.

The gist of what I’m proposing for a new Federal law is that when reporting Federal election results, all states must fully adhere to standard accounting practices.

The new law can adopt something like the 10 Principles of GAAP (Generally Accepted Accounting Practices), after tweaking them to be more election-specific.

It says there:

GAAP compliance makes the financial reporting process transparent and standardizes assumptions, terminology, definitions, and methods. External parties can easily compare financial statements issued by GAAP-compliant entities and safely assume consistency, which allows for quick and accurate cross-company comparisons.

In other words, such a Federal law would:

make the federal election reporting process transparent and standardize assumptions, terminology, definitions, and methods. External parties can easily compare election reports issued by different states, and safely assume consistency, which allows for quick and accurate state-to-state comparisons.

That we have fifty sets of election reporting rules, and zero consistency regarding such profoundly significant matters like transparency, is mind-boggling.

I would propose that the following be incorporated into the Federal Election Transparency Act of 2024 (ETA), for every state:

1 - Reporting of Federal ballot results must fully comply with the ETA.

2 - Each report of Federal ballots must be trackable by a unique UTC code.

3 - All positive Federal ballot reports must consist of just positive numbers from one or more precincts. When more than one precinct is included, the results from each individual precinct will be available for inspection.

4 - All negative Federal ballot reports must consist of just negative numbers from one or more precincts. When more than one precinct is included, the results from each precinct will be available for inspection. For every precinct reporting a negative, there should be a full explanation as to the reason for a negative ballot report, including the specifics of exactly what was corrected and why.

5 - Under no circumstances can positive and negative ballot tallies be combined into one UTC code.

6 - Complete ETA-compliant ballot results for all federal elections must be formally presented to the state legislators at least one (1) week prior to the statutory time for state legislators to certify federal ballot results.

7 - All ETA records must be kept for at least two (2) years.

I had originally suggested that this be made part of the ACE Act, but upon further reflection, this matter warrants its own law. Further, there is nothing “Republican” about wanting standard accounting practices to be used by every state for their election reporting, so this bill should have bipartisan support.

One might ask: why is this needed?

The short answer is that two reports from my team indicate that in 2020, over SEVEN MILLION suspect ballots fell into the category of having little or no transparency (3± million positives and 4± million negatives)! Further, since there is currently no prohibition against state reports combining positive and negative numbers, the actual amounts are likely much higher.

The bottom line is where we compare the data in Table 1 of this Report, plus the data from Page 2 of another Report, to the reported Biden lead for some key swing states. We’ve also listed the Electoral College votes for each state (270 needed to win).

Note 1: The Electoral College votes were: Biden = 306 and Trump = 232.

Note 2: If any three of the above states' Electoral College votes are changed to reflect the public's apparent wishes, the new totals would put Trump in a tie, or over 270.
Note 3:
Sources = Ballot Data, Electoral Votes, Ballot Spikes, Negative Ballots.

It should be extremely clear that the Positive Spikes and Negative Ballots are not trivial numbers. For example, in every case for these key swing states, both the 2020 Positive Spikes and the Negative Ballots, far exceed the Presidential vote differential. Yet there is little or no transparency for either of these!

In other words, it is imperative for the Federal Government to require every state to adhere to standard accounting practices in reporting (and keeping track of) federal election ballot results.

2 - The Rhyme and Reason of Negative Ballots?

Our election system's gaping loophole of non-transparent ballot "corrections"

By John Droz jr. Jan 15, 2024 @ Critical Thinking Skills

{This is the second installment of a five part series on the upcoming 2024 US elections. See Part 1 (what characteristics are needed for a winning President). Part 3 will be about 2020 election lawsuits. Part 4 will discuss whether or not electronic voting machines should be kept, and Part 5 will assess whether the 2020 election was mostly honest or dishonest.}

Those who dig into the election voting process will eventually come across the name: Edison Research. Who are they? Essentially what they do is act as a third-party, vote-reporting firm. Basically, they get ballot results from each state, and then pass these on to media sources like the NY Times, TV networks, etc.

Why are they in the loop? Consider the situation from the media’s perspective. On election night (etc.) to get Presidential election results (for example), they would have to be in almost constant contact with 50 states. Conversely, each of the election departments of 50 states would have to be in contact with numerous major media players. That would be a logistical nightmare, to say the least.

Edison steps in to be the middle man person to solve this problem. Now the NY Times, Fox, etc. get the election data for the entire country from just one source: Edison.

Fine, but what (if any) role does Edison play in any ballot shenanigans?

Generally speaking, to see Edison data, you have to be a paid subscriber — as they are a business, providing a service. They report (on Excel type documents), minute-by-minute ballot tallies, from each state. For example, for the 2020 Presidential election, there were some 21,000 line items (data points) that they passed onto customers.

One very suspicious matter is that some of these ballot tally line items are a negative number! For example, Edison might have reported at 11:30 PM on November 3rd, 2020, that there were -21,555 votes for Trump, in Nevada.

How can the number of new ballots at a certain time, from a state, for a specific candidate, be negative? Remember that this is not Edison’s number, but is rather what some particular state submitted to them for that time period and candidate. In other words, it is not likely that Edison has anything to do with the fact that there are negative ballot numbers. As the saying goes, don’t shoot the messenger.

So if we go back one step prior, to the submitting state, what is their explanation for giving Edison a negative number for a certain time period and candidate? Their stock answer is “a correction was being made.” (This could be legitimate, maybe due to something like a precinct’s tallies being mistakenly counted twice, earlier on.)

On the surface, this might seem plausible — but who is checking to see that no abuses are happening here? From what I know, almost no one.

Before we get excited about this, how many ballots are we talking about? If you carefully read this Report, two things jump out about the 2020 Presidential election ballot tabulations: a) there were over a thousand different reports of negative ballots, and b) the total number of negative ballots amounted to almost Four Million !!!

As bad as that is, the situation may be much worse. I say that because if bad actors were so bold to flag adjustments as negative numbers, then it is likely that some “corrections” are hidden in positive numbers. For example, if 50,000 ballots were about to be sent for Candidate A, they could subtract out a “correction” of 30,000, so that the reported amount is plus 20,000 — and no one would be the wiser.

In any case, these 4± MILLION “corrections” are not trivial amounts. That means that it’s all the more important that there is transparency here. Since Edison is simply a middle person, it is not reasonable to hold them accountable for these adjustments.

On the other hand, the submitting state should have accounting quality recordsavailable for public inspection — that explain each and every correction and/or negative ballot that they submit to Edison (or otherwise report).

How can this be fixed? IMO this is a relatively rare situation where the Federal government should be involved. Even though the Constitution says that the States have primary responsibility for elections, this is an accounting issue (not an election matter). Further, it makes sense that all states abide by the same accounting standard.

The House Republicans have recently put forward a national election bill called the American Confidence in Elections (ACE) Act. IMO this is the type of provision that should be added to it.

Here are my suggested words: “Any time a State publicly reports a Federal ballot tally that includes a correction of over 100 ballots, the State must have a full accounting for such an adjustment. These records must be available for public inspection, and must be maintained for at least two (2) years from the time of origination.”

Note that I put in an arbitrary minimum (100) to trigger this requirement, as it does not seem reasonable for the State to have to maintain records for a 5-ballot error, etc. I’m sure that some legal experts can fine-tune my draft words.

How important is this? IMO very. Bad actors are carefully looking for weak links in our election process, to be able to take advantage of them. That there is no national requirement for transparent change records for some 4± MILLION ballots is totally unacceptable.

Note that this issue is separate from large, unexpected ballot spikes. See my team’s Report on that matter. The bottom line is that 2020 Presidential ballot spikes totaled over three millionall in favor of one candidate!… These may all be legit, but they are statistically improbable. Again, top-notch accounting documentation is needed to assure the public that everything is on the up and up.

Maintaining such records is a normal practice for a business adhering to high-quality accounting standards. That is a good way to look at what needs to be done regarding our election system: from real audits to accurate record keeping, it needs to be made more business-like. Right now it’s like we are running a billion-dollar enterprise and keeping records on index cards, hidden in an unlocked desk drawer.

Little wonder that nefarious actors are in a feeding frenzy.

Since the media hasn’t done a good job of publicizing material they consider “contrarian,” we often get asked: what are some other quality 2020 election-related studies?  Although we haven’t done exhaustive research on other reports, here are some of our favorites:

These reports are specifically about voting machines (some of the above reports also discuss machines):

Election Integrity: Recommendations Report.

John Droz, Jr., Physicist, North Carolina

Today we are proud to announce the official public release of our Election Integrity:  Recommendations Report.   Although our team of independent experts has written eight other major reports pertaining to US elections, this is the most important one, by far. (Please pass on the link to this one-page document to anyone interested in the election integrity issue.)

We’ve been working on this for about two months, and set for ourselves four (4) standards that this report should meet: Competent, Comprehensive, Collaborative and Creative.  For those who favor brevity, we have also posted a one-page document listing our thirty recommendations. Let me know any questions, or improvements to this report.

Please pass this information onto your social media sites, friends & family, and anyone else who values America. If we don’t have election integrity, every other aspect of our life will be adversely affected.

Vote Integrity: AWED Special Report

By John Droz Jr. physicist & citizen advocate

Hard to believe it's already February and tomorrow is groundhog day!  Welcome to a special edition of our Energy & Environmental Newsletter... (For all 2020 Newsletters, go here.)

This special issue is based on this premise:

"Nobody made a greater mistake than he who did nothing, because he could only do a little. Edmund Burke

Note: If you are getting this Newsletter from a friend, please email physicist John Droz for your own free periodic copy.

IMO there are few things more important to a free society than vote integrity. If citizen's voices are adulterated, we are untethered from democracy.

In such a situation no person who appreciates the sacrifices of hundreds of thousands of lives that have given us the freedoms we have today, would even think of saying anything like:

"Move along, as there is nothing to see here."

What is fueling this precipitous slide towards the bottom, is a mainstream media that rationalizes their diatribes as "the end justifies the means.  They have decided what's in our best interest, and their "presstitution" is designed to propagate their beliefs on us. (These are the same people supposedly wary of Russian influence!)

A "relevant"example is the reporting about the 2020 Presidential election-related lawsuits. What have you heard and seen? Are you aware that the majority of the adjudicated cases have been won by Trump, et al?!  Please read the specifics.

Here are some inside analyses that should make the election situation clearer:

PS: For those who honestly believe that the 2020 Presidential elections was fair and square (with only minor irregularities), they should be leading the pack to do selective forensic audits, as those will then prove their position to be accurate.

Note 1: We recommend reading the Newsletter on your computer, not your phone, as some documents (e.g. PDFs) are much easier to read on a large computer screen. We've tried to use common fonts, etc. to minimize display issues.

Note 2: To accommodate numerous requests received about prior articles, we've put together detailed archives where you can search by year, or over the ten plus years of the Newsletter. For a detailed background about the Newsletter, please read this.

Note 3: See this extensive list of reasonable books on climate change. As a parallel effort, we have also put together a list of some good books related to industrial wind energy. Both topics are also extensively covered on WiseEnergy.org.

Note 4: If at any time you'd like to be added to (or taken off) this free distribution, simply send me an email saying that.

Note 5: I am not an attorney or a physician, so no material appearing in any of the  Newsletters (or the WiseEnergy.org website) should be construed as giving legal or medical advice. My recommendation has always been: consult a competent, licensed attorney when you are involved with legal issues, and consult a competent physician regarding medical issues.

2020 Presidential Election Lawsuits — the Facts

By John Droz, jr., Physicist, North Carolina 2-1-21

It’s beyond exasperating to keep hearing the cacophony of chicanery about the 2020 Presidential election-related lawsuits.

The Left’s message to the public is that there were no consequential 2020 Presidential election malfeasance, irregularities or illegalities — supposedly because the courts objectively and thoroughly investigated those claims, and ruled them to be unfounded.

Neither element of that assertion is even remotely true.

To counter the later part of that false narrative, a team of independent volunteer (unpaid) scientists and engineers recently put together a List of Lawsuits involving the 2020 Presidential election. In it we identified the issues at stake, how each case was treated by the courts, what evidence was objectively analyzed, who won and lost, etc.

We tried to walk a narrow line of not only having a comprehensive list, but also information easy enough for the public to understand. (For example, since none of us are attorneys, we consciously tried to avoid unnecessary legal jargon.)

To further assist in the understanding of this important list, we simplified 20+ pages of filings and decisions on each case into a one or two sentence summary. (If we didn't do justice to any of these, please let me know and I’ll issue an update.)

Another idea we implemented was to color-code the decisions — to make it easy for the reader to segregate the various outcomes.

Lastly, we passed this list by over a dozen lawyers involved with election-related lawsuits. The typical response we received was “Excellent!”.

So what are the takeaways?

To begin with our list shows that there have been sixty-five (65) lawsuits filed that are relevant to the 2020 Presidential election. (Note 1: we are counting an original filing, plus additional appeals as one single case. Note 2: other lawsuits are possibly undiscovered.)

The results to date are:

a) Six cases have been withdrawn or consolidated. (These are not wins or losses to either side.)

b) Twenty-four cases have been stopped from proceeding (dismissed) due to legal technicalities (standing, timing, jurisdiction, etc.). These have nothing to do with the merits of the case and should also not be considered wins or losses for either side.

That more than a third of the lawsuits were not allowed to proceed to an evidentiary hearing is more of an indictment that many judges appear to be afraid of opening this pandora’s box. Considering the importance of election integrity to our country, it’s a shame for them to hide behind subjective legal technicalities. How is that in the interest of the citizens in our country?

In any case, this leaves us with thirty-five (35) lawsuits relevant to the 2020 Presidential election where a judge has ruled (or hopefully will rule) on the merits. The results so far are:

c) Sixteen cases are completed (adjudicated). These are where the court heard arguments, considered evidence (where applicable), and then formally ruled on statutory issues (e.g. the legality of a state’s election process), etc. Of these:

 i) Nine cases were WON by Trump, et al, and

ii) Seven cases were lost by Trump, et al.

d) Nineteen cases are still active and have not yet been decided — so the ultimate winner and loser of these cases has not been determined.

So, Trump (et al) have WON the majority of 2020 election cases fully heard, and then decided on the merits! Is that what the mainstream media is reporting.

Note that despite all the noise about fraud, only three (3) of these lawsuits materially dealt with voter illegalities (citizens voting twice, votes from deceased persons, etc.). Interestingly, all three of these cases are still open.

Further, just three (3) lawsuits addressed voting machine inaccuracies (purposeful or accidental). One of these was dismissed (due to jurisdiction), one was ruled against (although no discovery was granted), and one is still open (discovery was granted).

The likely explanation for so few cases in these two areas is that legally proving fraud or voting machine manipulations are very time-consuming processes, that require substantial investigative work and documentation. There simply wasn’t enough time to do this prior to key points in the process (like the Electoral College). Additionally, it’s likely that any machine algorithms would be erased by the time a forensic investigation takes place.

Our view is that the public needs to be much better educated regarding the election integrity issue — and having a more accurate understanding of the lawsuit component is a key part of that.
