Why Is AG Garland Willing to Go to the Wall Over Hur Tapes?

The wrath of Congress should not be lightly dismissed.

Late Wednesday, June 12, Attorney General Merrick Garland was on the receiving end of a contempt of Congress vote, making him the third such officeholder to face the wrath of the House. In a 216 to 207, mostly party-line vote, GOP lawmakers held Garland in contempt for refusing to hand over audio files related to President Joe Biden’s interview with Special Counsel Robert Hur. While the AG cites politicization as the impetus for this action, the real question concerns why he would refuse to comply in the first place.

Garland Refuses to Budge

Special Counsel Hur oversaw the investigation into Biden’s mishandling of classified documents. The process saw the commander-in-chief sit down for two interviews last October. Despite myriad news reports suggesting the president was exonerated of wrongdoing, Mr. Hur actually determined that while “wilful” mishandling took place, a jury may not convict Biden and that he would come across as an “elderly man with a poor memory.”

The transcripts were released, and the left-leaning Fourth Estate declared that such evidence of cognitive decline was not apparent. Indeed, Mr. Biden’s own lawyers decried the report, calling it an unfair and unprofessional observation. Surely, if such a mischaracterization took place, those who disagree would want the audio published widely. What better way to dispel a falsehood than to disinfect with sunlight?

AG Garland, however, advised that the president should claim executive privilege over the recordings.

Something to Hide?

There are two arguments in play for the refusal to comply with the House’s subpoena. The first is that Mr. Garland claims he can see no legislative purpose in releasing the recordings. The other is wildly speculative fearmongering that the audio may be manipulated by artificial intelligence and promote disinformation.

In a novel legal filing, the Department of Justice claimed AI tampering was a sound reason for the withholding, writing:

“The passage of time and advancements in audio, artificial intelligence, and ‘deep fake’ technologies only amplify concerns about malicious manipulation of audio files. If the audio recording is released here, it is easy to foresee that it could be improperly altered, and that the altered file could be passed off as an authentic recording and widely distributed.

“A malicious actor could slow down the speed of the recording or insert words that President Biden did not say or delete words that he did say… That problem is exacerbated by the fact that there is now widely available technology that can be used to create entirely different audio ‘deepfakes’ based on a recording.”

There appear to be a few problems with this line of argument. First, as the transcript is widely available, the insertion of words would be easily dealt with. Unless, of course, the original transcript had already been edited in such a way. This is something that the White House comms team has done on numerous occasions to “tidy up” Mr. Biden’s speeches. However, this is unlikely to be something the DOJ would do.

Another aspect to consider is that if the DOJ’s argument passes legal muster, what is to stop all audio and video footage of any president being withheld under the same rationale?

So, what of the legislative purpose argument? It is worth noting that the government agencies fall under congressional oversight. It is not for a department to determine what Congress should and should not be investigating. In fact, lawmakers have a very real and practical interest in discovering whether Mr. Hur’s written report tells the full story – especially as the Biden administration has called it a complete mischaracterization.

Next Steps for Garland

Despite the contempt charge, the head of the DOJ has little to worry about. When AGs Bill Barr (under Donald Trump) and Eric Holder (under Barack Obama) were held in contempt, the US Attorney in Washington, DC, declined to pursue charges.

AG Garland responded to the contempt of Congress vote in a statement, accusing House Republicans of turning “a serious congressional authority into a partisan weapon.” He continued:

“Today’s vote disregards the constitutional separation of powers, the Justice Department’s need to protect its investigations, and the substantial amount of information we have provided to the Committees.”

This refutation comes hot on the heels of AG Garland writing an op-ed in the pages of Washington, DC’s most notable newspaper on June 11. In his article, he claimed: “In recent weeks, we have seen an escalation of attacks that go far beyond public scrutiny, criticism, and legitimate and necessary oversight of our work. They are baseless, personal and dangerous.”


“Continued unfounded attacks against the Justice Department’s employees are dangerous for people’s safety,” he wrote. “They are dangerous for our democracy. This must stop.”

While this was certainly a political powerplay by the House GOP, it would be a stretch of the imagination to believe Mr. Garland’s accusation that lawmakers seeking to obtain an audio file that would determine if Mr. Biden’s lawyers’ claim of mischaracterization was true or false is a danger to “our democracy.” It may well turn out to be, however, a threat to Mr. Biden’s chances in the 2024 election.

What's Interesting About the Steve Bannon Verdict

October 21, 2022 Former top Trump White House adviser and media executive Steve Bannon was sentenced to four months in jail for defying congressional subpoenas regarding the January 6 riot. The select committee compelled the Trump aide to turn over any documents related to the Capitol scuffle, but he refused to comply. Bannon also refused to appear before the panel to testify, prompting two guilty verdicts for contempt of Congress (via Axios):..........

Liberals probably are rejoicing as Bannon is reviled among their circles. Still, while a four-month jail sentence was handed down—the Department of Justice wanted six months—Bannon has vowed to fight to the bitter end. Judge Carl Nichols, a Trump appointee, rendered his judgment, admonishing Bannon for disrespecting the legislative branch but did admit in his ruling that Mr. Bannon does have ample grounds for appeal. He also said Bannon could remain free while that process is hashed out in the courts. My Take - Again, I chuckle when I see someone was "found to be in contempt of Congress" stuff.  You can't walk anywhere in the nation without tripping over the nation's contempt for Congress, and they have to "find" it. Remarkable, ya just gotta see the humor in that.   At any rate, you may wish to view my file.  He's a strange one.

The Structural Legal Rot Runs Deep

With the likelihood of a Republican tsunami at the midterms, some are already spinning wish lists of structural changes they hope will begin to take shape. Without wishing to rain on their -- or your -- parade, I’d like to point out how deep by now the structural rot goes. It’s beyond the collapse of academia and K-12 education, the evisceration of our military, government waste, the dysfunction of our health system, and the one-sidedness of media coverage. It goes to the very heart of our legal system.

This week Peter Navarro was charged by a D.C. grand jury for contempt of Congress for refusing to cooperate with the House Select Committee, a purely partisan confection of Nancy Pelosi in violation of all the traditional House rules, and a clear propaganda operation. (Mark Meadows and Dan Scavino, Jr. cooperated to some extent and were spared. The committee also referred them for prosecution, but the department of Justice declined to prosecute them.)

The charge against Navarro is a misdemeanor process crime but with significant possible consequences. 

Instead of following the normal procedure in such cases of notifying the person charged and allowing them to report for processing, the FBI affected to humiliate him, arrested him as he was boarding a plane and publicly handcuffing him and placing him in leg irons.

When I got to Congress, I found out, here's why we are in trillions of dollars of debt. Here's why our country feels like it is crumbling. Here's why the business -- it's a business, that's what Congress is, it runs the country -- this is why this business is failing, failing America, it's because most of the people that are there are not qualified to be there.

There are people that can only succeed in government or academia, or maybe they are attorneys that could not build their career big enough, so they decided to go into politics, or people that just pursued a political career because they love that life for what being a member of Congress gives them.......To Read More...

My Take - Greene answers Carlson when he says her description says: "They sound like losers," Carlson -- another target of media leftists -- told Greene: "I think a lot of them are losers," Greene agreed.  Well,, I've been involved in my industry's affairs for many years and I've met a lot of elected officials and in point of fact....she's right.  A lot of them are losers.  A lot are successful business people also, but somehow when they get elected they all of a sudden forget all those winning traits that made them successful and adopt leftist insanity.  Ergo....losers.

Nadler's show trial, not Barr, deserves to be held in contempt

It's just three weeks since House Judiciary Committee Chairman Jerry Nadler subpoenaed the report without redactions , and all its underlying evidence, from special counsel Robert Mueller relating to his investigation of Russian interference in the 2016 election.

Despite this, Nadler, D-N.Y., and fellow panel Democrats voted 24-16 Wednesday to hold Attorney General William Barr in contempt of Congress for failing to comply in the blink of an eye with their demand. Never mind that it would have been illegal for Barr to do so. It will be for the full House to decide whether to support the contempt vote, but House Speaker Nancy Pelosi, D-Calif., has said she'll follow the committee's lead.

Democrats took turns grandstanding at the hearing, and simply ignored the fact that it would be against the law for Barr to disseminate some redacted material in Mueller's report. Nor did they acknowledge the mammoth amount of work that would be required to organize and hand over Mueller's mountains of evidence.

It's, of course, not surprising that no Democrat objected to Nadler's precipitous actions for, in 2019, congressional oversight consisting of forming up on one side of the committee room and barking at the other side..........To Read More.....

My Take - I really, really, like this guy!  I hope he has the guts to keep it up because he's a gift that never stops giving.  If he was any more ridiculous, he'd be Maxine.  The thing I like the best is the more information they demand the more information comes out how corrupt the Democrats were during the 2016 election, and more.  Just think, Jerry's going to help prosecute his own.  Wow!  I just had a thought - maybe he and Maxine are related.
