Trump May Cancel Habeas Corpus Over SCOTUS Injunction Cases

Will President Trump join Lincoln and Clinton in restricting court access?

The Constitution gives the president the power to suspend a key protection afforded to those seized by the government. Stymied by multiple nationwide injunctions initiated by district court judges, President Trump may now institute that power on the eve of an oddball Supreme Court case set for argument on Thursday, May 15th. The administration has sort of given the High Court an ultimatum: rein in the lower courts, or habeas protections will go away.

Habeas corpus refers to the power of courts to demand that the executive produce a detainee or prisoner before the Court to challenge the deprivation of liberty. Thomas Jefferson wrote: “The Habeas corpus secures every man here, alien or citizen, against everything which is not law, whatever shape it may assume.” Absent this power, courts and petitioners would be toothless before the executive power to deprive anyone of their liberty, no matter the law or the Constitution. Yet, the Constitution itself says the president can suspend habeas – in certain circumstances:

“The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”

The current controversy concerns President Trump’s day-one executive order on birthright citizenship – denying US citizenship to those whose parents were in the country illegally when they were born. Three district court judges implemented nationwide bans on administration efforts to execute Trump’s order. At his latest cabinet meeting, a reporter asked him if he had “spoken to his team about ways to mitigate this.” Trump seemed to make a point of not using the words habeas corpus or discussing eliminating access to the right at the time. Instead, he said: “There is one way that has been used very successfully by three presidents – all highly respected – but we hope that we don’t have to go that route.”

That coy discussion has gone by the wayside. White House Deputy Chief of Staff Stephen Miller told a press gaggle Friday that suspending habeas corpus is “an option we’re actively looking at” and “a lot of it depends on whether the courts do the right thing or not.” Nationwide injunctions issued by district courts have become a problem at the forefront of the federal judiciary since Trump’s first term. They were exceedingly rare before 2016. According to a study published in the Harvard Law Review, however, over 50% of all such injunctions issued since 1963 have been against the Trump administration. The president asked the Supreme Court for an emergency review of three injunctions, and it said yes. His petition reads:

“The government comes to this Court with a ‘modest’ request: while the parties litigate weighty merits questions, the Court should ‘restrict the scope’ of multiple preliminary injunctions that ‘purpor[t] to cover every person in the country,’ limiting those injunctions to parties actually within the courts’ power.”

The Supreme Court will hear consolidated arguments in Trump v. Casa, Trump v. Washington, and Trump v. New Jersey at 10 a.m. on Thursday, May 15th. They have allotted one hour for the arguments, thusly – 30 minutes for Solicitor General D. John Sauer, arguing for the Trump administration, and 15 minutes each for N.J. Attorney General Jeremy M. Feigenbaum and Kelsi B. Corkran, both arguing to keep the injunctions in place. All three advocates served as Supreme Court clerks. Sauer for Justice Antonin Scalia, Feigenbaum for Justice Elena Kagan, and Ms. Corkran, the Supreme Court Director at a Georgetown law institute, clerked for Justice Ruth Bader Ginsburg.

A decision is expected by July.

Observations From the Back Row

Where did federal district judges get the idea they were in charge of the nation's immigration polices?  First of all, illegal aliens are all ..... all.... criminals because entering the nation illegally is a felony, so deportation should be an automatic.  The only due process they merit is to determine if they're here legally or not.  If not, that ends due process and goes right to deportation.   Federal courts are even demanding illegal aliens who are known members of criminal gangs with have a history of serious crimes be returned to the United States. 

Americans are now second class citizens in their own country in favor of illegal migrants costing taxpayers billions.  In fact, we're now seeing judges and governors openly breaking the law protecting them and attempting to prevent deporting them.  

This is all part and parcel of Joe Biden's scheme to assure unending control of America by the Democrat party.  He allowed hundreds of thousands to swarm over the border and then shipped them inland as quickly as possible never to be seen again, with a due process scheme that would take ten years.  In the meanwhile they're having children.  Then the left claims since they now have children who are America citizens they can't be deported.  Wrong, they can be deported, and taking their children with them isn't like Nazis sending children to the gas chambers.  

This wasn't an original idea by Joe Biden, if he ever had one, and it's now clear he had no idea what was going on in his administration.  It turns out there were three auto-pens in the White House, and the far left staff controlled all three.   This has been in the works for decades.  It's the Cloward-Piven scheme to destroy the nation by creating a massive welfare state then over loading and collapsing the system in order to create a crisis so grave it would justify overturning the Constitution and imposing a tyrannical system of socialism on America.   These illegal alien schemes are the perfect fit to that corrupt treasonous scheme.

The Canada Free Press asked why Trump is the focus in their election instead of the Liberal party’s scandalous mismanagement?  The author points out "Canadians have long hated any Republican in power, having been conditioned to do so by a longstanding Marxist media", with writer after writer pointing out leftists are ruining Canada.  Well, apparently Canadians like being ruined because within three hours of the polls closing they called the election for the leftists who are there now, globalist tyrants all.   All of whom want to pick a fight with Trump.  Good luck with that Canada. 

And we want to make Canada America’s fifty-first state why?  They refuse to control their borders, crime is rampant, everything costs more there, their health care system is a mess, rights as we know them do not exist in Canada and their citizens are abused by their government, free speech is punished, Canada is not a free nation.  Not to mention the fact there would end up being so many more leftists in the Congress conservatives would never gain control again.  Canadians are not Americans and it's fairly clear their frozen country is a banana republic. 

Finally, these globalists who go into apoplectic hysteria over people flying from one destination to another claiming the world will burn up into a cinder if that's not stopped, are all flying to Davos, in private jets, for the meeting of the World Economic Forum, to which USAID gave $68 million dollars.

Bernie Sanders, a long time advocate of climate change tyranny, along with AOC, traveled all around the nation.... in a private jet..... to express their outrage at the rich.  And she wants to be President of the United States.  A young energetic bartender who, like Bernie Sanders, wants to be one of the rich she hates.  Imagine that!

Judiciary Supremacy is a Myth

Judicial activist's are at war with the Constitution's separation of powers, and it's time to bring this to an end.  Finally after all this insanity by rogue judges, Trump has told them to shove it.  We'll come back to that.

Federal judges have claimed that the White House can’t mange the bureaucracy, can't offer buyouts to federal employees, can’t fire political appointees from the previous administrations, can’t pause funding, can’t cut funds to government programs, can’t change formulas allocating government grants and also can’t remove transgender ideology from government websites or the military installed by its predecessors, and cannot under any circumstances end the vast corruption that defines the Administrative State.  

The only court the Constitution creates is the Supreme Court, the rest are all creations of Congress, and they can get rid of those if they choose.  When you read about how this came about it almost seems like it was an after thought to most of them. Clearly lacking insight and vision.

As a result the other huge mistake the Founder made was not defining the duties, responsibilities, and boundaries for the Supreme Court, and then by giving them lifetime appointments that allowed them to determine what they were, and if there were any on their own. I doubt most of the Founders ever dreamed it would all get so big, and so fast.

If you notice no one in the Trump administration seems to be panicking. No hysterics and emotionally ineffective hyperventilating, so, I’m of the opinion Trump and Co. knew this was going to happen, perhaps hoping it would happen, setting the judiciary up for a Constitutional confrontation. The federal judiciary has been a loose cannon since the 1803 Marbury v. Madison ruling,  and now it’s almost completely out of control, and to the point the general public is seeing them for who and what they are, and the public doesn’t like it, many fearing the courts threaten the existence of the Republic.

The Constitution says the Congress determines the jurisdiction of the federal judiciary, not the judiciary

This is the opportunity to push Congress to exercise their Constitutional authority to start restricting the federal judiciary’s activist judges, and more importantly pass a Constitutional Amendment that does two things. Ends lifetime appointments, and do what the founders failed to do…. define the role of the judiciary, and with consequences for failing to stay within the boundaries of those definitions.   And any Constitutional Amendment that fixes this should include a provision that all federal judges must be natural born citizens.

As I stated, the only court the Constitution creates is the Supreme Court, and when you read about how this came about it almost seems like it was an after thought to most of them. Clearly lacking insight and vision.

The idea behind lifetime appointments was to ensure their independence and not be impacted by politics.  That has been an abject failure almost from the beginning, and in the last 100 years it’s been a dismal failure, one that’s been tolerated by the Congress.

The courts gave themselves that power, not the Constitution. The Constitution says it’s the Congress that determines their jurisdiction, and the failure of the Congress to stop so much of what has gone on doesn’t make the federal judiciary’s actions successful, or right, it merely shows how gutless Congress is.

When the founders put this in the Constitution those who opposed it warned the very things we’re seeing right now was going to happen, and they were right, as people will always be people, and people need boundaries to hold them in check.

 The federal judiciary after the Supreme Courts Marbury v. Madison decision in 1803 has morphed into an almost entirely political institution that just occasionally rules harmoniously with the Constitution.  

The federal judiciary is filled with political hacks, and if you ever watched some of the judiciary hearings for those who are nominated, especially when Senator John Kennedy is questioning them, you can easily conclude most of them are not the brightest pebbles in the brook, and they're dishonest.  

There's a nautical phrase, "may you have follows seas", which means may the waves move in the same direction as the ship, and I'm of the opinion that's what will be happening in the federal judiciary.  Not for all, because some are blatantly corrupt and incompetent ideologues, and we can't replace them without their consent.  That needs to be changed.

Everyone on the left is relying on the courts to ignore the Constitution to stop Trump’s “restoration to normality”, and this is the hill conservatives need to die on by challenging the myth of judicial supremacy, and better yet....again pass a Constitutional Amendment to fix the founder’s greatest Constitutional error; lifetime appointments for the federal judiciary. 

The Constitution says the supreme commander of America's military is the President of the United States.  The judiciary thinks they are!

Follow the money: 10 Dem-appointed judges blocking Trump 'They are trying to make it hard for the administration to pursue its agenda' - Federal judges ruling against President Donald Trump's recent executive actions have been almost entirely appointees of his two Democrat predecessors. Some were previously activists, others were steeped in Democrat politics, and one is a former clerk for then-Judge Sonia Sotomayor. These judges have issued rulings to block Trump's policies on immigration, federal spending, the Department of Government Efficiency, and other matters....
 
After all the lawfare corruption and the outrageous behavior of the federal courts does any sane person in America have faith in the judiciary?  This is a war, and it's going to get messy.  
Trump is draining the swamp, and the courts are telling him they don't approve, and are making decisions to prevent that.  Blatant judicial overreach”, illegally seizing power to block Trump's Constitutionally mandated responsibilities.   All of which is no only illegal it's  unprecedented.   All this is nothing short of a national conspiracy by the left to thwart Trump's agenda by flooding the courts with lawsuits.  
 
 
One of the most egregious of these radical judges is U.S. District Judge Amy Berman Jackson, and she's decided the bureaucracy controls the Executive branch, not the President of the United States.

DOGE

If the President of the United States appoints someone to undertake some task, that's his right and responsibility under Article II of the Constitution, and this argument these DOGE employees don't have the proper security clearances is horsepucky. The intimate authority on security clearances is the President of the United states. If says their cleared, they're cleared, and he doesn't need confirmation or permission from the FBI or anyone else. Most assuredly he doesn't need permission from the federal judiciary. 

DOGE has exposed amazing levels of waste, and the corruption by the Administrative State is so bad,it makes the 19th century’s patronage system look good.  In spite of that the federal judiciary says none of that matters.

  • Judge Rules Against DOGE Access to Personal Data -A federal judge temporarily barred the Department of Government Efficiency from gaining access to sensitive employee information held by the Office of Personnel Management and the Education Department, reports Reuters. OPM is essentially the HR department of the government, notes Politico, which calls the ruling by US District Judge Deborah Boardman in Maryland "the most wide-ranging block on DOGE's activities to date." Unless overturned, it could seriously crimp Musk's team. The judge is an appointee of former President Biden.......

How dare the President appoint people to carry out his orders demanding information and accountability?  The message from the judiciary?  Let the corruption continue. 

HIRING AND FIRING

I've tried to save articles dealing with all the issues the defines the problems between the Judicial and the Executive  branches of government.  One of the arguments from the courts is these people he's firing had terms of office, and they're right.  But they didn't have immunity to firing.  If the President of the United States feels they need fired, they're fired, irrespective if their term in office hasn't finished yet.  

The President of the United States is the Executive, and those decisions are his alone.  The courts have no jurisdiction, and even if Congress were to pass a law that tried to make those appointments permanent and a President signed off on that, none of that changes the Constitution which declares that the "executive power is vested in the President."  

Any law passed by Congress does not obviate what's laid out in the Constitution, and they've been trying to do that for decades, the right to bear arms is just one of many examples.  

Judge Blocks Trump’s Firing of Head of Office of Special Counsel - A federal judge has ruled against President Donald Trump’s firing of Hampton Dellinger, head of a federal watchdog agency, in the first ruling on a case that will test the scope of presidential power, after the Trump administration’s petition to the Supreme Court to fast-track the case was knocked back.

Until now I’ve felt impeachment of federal judges was just a waste of time, even Jefferson noted to get the required two thirds vote in the Senate was going to make it almost impossible, and that was when the Congress was far more harmonious, and much, much smaller.  I now think that’s a worthwhile endeavor, not because I think the Senate will concur, but because it will force transparency on how these misfits are abusing their positions, and the Constitution.  Hopefully that will create impetus for a Constitutional Amendment that ends lifetime appointments to the judiciary.

IMMIGRATION 

In spite of the nation's laws governing immigration, which falls in the domain of the legislature and the executive, the courts have decided the Constitution is all wrong, they know better, and it's time for the nation to finally understand it's up to them to make the nation's laws, because they don't like the laws that Congress passed.

SPENDING

Article I of the Constitution states:  

All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and a House of Representatives.” The Constitution first vests all federal legislative powers in a representative bicameral Congress.  

Nowhere does it give the Judiciary legislative power.  The budget process belongs to the Congress, with confirmation by the President.  Nowhere in the Constitution does the Judiciary have a say in that matter, although they've usurped that on a regular basis.

Even the Supreme Court has fallen victim to the insanity on spending,  Supreme Court Says Trump Admin. Must Pay $2 Billion in USAID Funds, here, here, here, here, and it didn't set well with four of the justices.  You may find this article interesting, How powerful is the Supreme Court?

Well, none of this is sitting well with a lot of people.   Articles of Impeachment are being filed, but that's a hard row to hoe but I think it's worth the time in order to publicly expose what they're doing is illegal.  This idea has been floated but it would still be an exposure solution, not a final solution.  It might be worthwhile for the Congress to hold hearings calling all these misfits before them and making them explain their decisions.  This article asks an amazingly pertinent question. If the Supreme Court Is Going to Ignore the Constitution, Trump Should Ignore the Supreme Court.

Finally, and as we've watched this playing out you knew it had to come,  President Trump Signs an Order That He Will Ignore All Lower Court Rulings Until SCOTUS Rules on the Constitutionality of Activist Judges.  Now the ball is in SCOTUS' court.

P&D and The Week That Was

This week it was reported that China launched a new sixth generation jet fighter, and it appears its impressive, and most likely with stolen technology.  Well, so what?  

As Francis Menton points out in his article about the the eventual consequences of socialist central planning nations, (they all end up in the crapper, make sure to read about Cuba and Venezuela) and notes China's economics is all smoke, mirrors, with massive unpayable debt, bad investments, and incredibly bad economic planning.  Not only are they attempting to justify their failures, they're doubling down on them, which will lead to the same thing that destroyed the Soviet Union.  The Russians, with their idiotic economic schemes tried to compete militarily with the United States and still fund the needs of their people.   They couldn't and they went broke.

The fact is China is already broke, and modern high tech military equipment is massively expensive to develop, even if that technology was stolen, massively expensive to build, and massively expensive to maintain, and ...... they're broke.  And when Trump starts blasting them with greater economic sanctions, he may actually be able to undo what Nixon wrought, which was opening China up to world trade.  As a result, western civilization has been financing China's efforts to destroy western civilization, and the big corporations are willing participants to that destruction totally committed to profits irrespective of the long term negative consequences, and their corrupt allies in government support them.  As allies, big corporations are ..... on their best days ..... leaky vessels.  On their worst days, they're traitors, and so are their supporters.  

In years gone by it was reported that "seven in 10 young Americans are ineligible to serve in the military. For a quarter of those, the reason is they are too fat. Military groups argue these numbers show Congress should not retreat from the fight to implement new nutrition standards in schools".   Hogwash.  Let’s get real.  It’s still all about calories in and calories out.  If kids don’t exercise they get fat…. period.  

 The next time you drive past a public baseball diamond notice what’s there.  No one!  In days gone by they were played on daily…every day!  Now the kids watch television, play games on computers…that’s especially a problem… and phones to jabber on or text to with their friends all day, none of which burns any real calories.  Let’s get this – people are going to do what they want to do, and real leadership is encouraging people to do what they should and help them do what they would.  Central planning is a waste of money, along with editorial blathering and hand wringing.   

America's courts are in dire need of purging, as is easily demonstrated in this Iowa Supreme Court case, which threw out the Fourth Amendment of the Constitution. So, how is that to be accomplished?  Purging law schools of the freaks teaching there, and that can be done by revoking their university credentials to teach for unacceptable practices, end all funding of any kind including student loans, publicly state no graduate will be hired from these universities, such as to the federal government, and place restrictions on any law firm that does hire them.  And suing them for.... whatever works.... after all, they made up the rules of the game, and now should have to live with them, and it appears that Harvard has gotten the message. 

Is Trump having second thoughts about Speaker Johnson?  If not, perhaps he should take a look at the latest polls that show a huge percentage of the Republican base want him gone as being totally untrustworthy. 

I recently read an article that claimed fixing the government's economics problems was impossible due to programs like, but not exclusive to, Social Security, Medicare and Medicaid, and the arguments were profound....and they were wrong.   

The federal government has, as of 2013, assets of over 150 trillion dollars.  They could wipe out the nation debt, saving just under a trillion dollars in interest payments, return the trillions they stole from Social Security, sell off the landmass in America owned by the federal government (to the tune of almost 25 percent) allowing for capitalization of that land, reduce idiotic regulations which would turn America capitalism loose like a force of nature.   Social Security could be privatized, and based on how it's been terribly mismanaged it should be. The massive levels of corruption and incompetence in all these programs which has made all this so expensive can be addressed and fixed, and that fix starts with reduction the federal government by 80%.  That's doable, and would be done without impacting the economic health of the nation, if anything, it will improve the nation's economic health. 

Take a look at what the federal government is wasting the tax payers money on.

Trump thinks Canada should become America's 51st state, and there's been a lot of talk about that, with a lot of Canadian kickback, but it also appears.... and I use the word appears deliberately ....Some Canadians actually like Trump's idea of annexing Canada to the U.S.  Well, here was my thoughts on that.  

First, Canada is like France, their right is like our RINO's only more left, and if their ten provinces come as separate states, that means 20 more leftist Senators and untold leftist Members of Congress. Wow! What a great idea, what could possibly go wrong? 

One commenter said: What you don't understand is that most of Canada, like most of the population in our loony leftist-"led" states, isn't loony leftists.  I responded saying: Really? Wow! They must really have a serious problem with voter fraud in Canada! Right? 

I have a friend who retired to Colorado, which was a once reliable Red state until all the far left nitwits from California moved there to escape the disaster they created in California and then quickly instituted the insanity they fled in Colorado.  Outside of Colorado's major cities my friend says the people may be even more conservative than me, but the cities have the numbers.  The same is true in Oregon, and the exact same thing would happen with Canada. 

Bird flu has been confirmed, and it appears this one has..... watch out now.... here it comes..... mutations.  And we should be shocked this virus is just like every other virus in the ability to change?  Will the bird flu mutate to be able to attack people. Given the history of virus's the answer is it's quite probably.  The real question is will the government attempt to impose  tyrannous control over society as they did with covid, which was not only a bust, it was totally  fraudulent and corrupt, which I  from the start of all that.    

The only thing I didn't know at the beginning was these were not vaccines, they're gene manipulating chemical compounds that are now having, and will have, a massively negative impact on human health for decades, and I pointed that out as soon as I became aware of it. 

So, the question everyone should be asking is this. If the bugman knew this how could all these professionals not know it?  One more disaster this caused.  My old man's morning breakfast group couldn't meet an McDonalds any longer, and since then some have passed and no one thinks the price is worth going any longer.   Let's face it, If Fast Food Isn’t Fast, Hot, Cheap and Good Tasting - It’s Not Worth It, and that was eleven years go.

Today I have five commentaries of my own and two dealing with the collapse of Europe, which again, I predicted this ten years ago.  These two deal with the UK and France, but next week I will be covering more of these nations.  Europe is doomed, demographically, economically, and philosophically, because it's bereft of any stable moral foundation.  And socialism isn't stable in any form.   I listed an old one first as I think that lays important foundation for the rest, so read it first.
