Can Justice Kavanaugh sue for defamation?

Another accusation against Justice Kavanaugh is up in smoke. According to news reports, a woman named Judy Munro-Leighton was not telling the truth about a rape accusation.  As a consequence, Senator Grassley wants to investigate the matter:............ She never met him. He never raped her.
It's time for Justice Kavanaugh to consider a defamation suit.  Maybe he can't as a public person.

Maybe he does not want to put his family through this. However, we have in this lady's own words that the whole thing was the work of partisan and angry Democrats.  They set out to destroy a good man and nearly did. My Take - Defamation of character lawsuits for a public figure, or worse yet a public official, are difficult to win.  It varies from state to state, and in Florida they have to prove "malicious intent", which seems to be the standard. 

What has to be proved is this:
"the party defaming them knew the statements were false, made them with actual malice, or was negligent in saying or writing them. Proving these elements can be an uphill battle. However, an outrageously inaccurate statement that's harmful to one's career can be grounds for a successful defamation suit, even if the subject is famous. For example, some celebrities have won suits against tabloids for false statements regarding their ability to work, such as an inaccurate statement that the star had a drinking problem."
I agree someone needs to be sued, if for no other reason as a deterrent to future outrages. 

It gets worse!

What's pathetic and a clear indicator of how corrupt Kamala Harris is, she's involved in this.  It appears this letter about Kavanaugh raping this woman was sent to Harris' office.   She had to know, or should have known, this woman was a left wing activist decades older than Kavanaugh, and none of this could possibly be true.  It's clear she didn't care.  And now this woman is doing a mea culpa, and in point of fact, she's in trouble.  If she's coming forward I have to wonder:  Does she's have a deal in mind to implicate her attorney Michael Avenatti. or possibly Harris?
