Obama's Empty Judicial Chairs

On a hot day in June, the grandson of a bank president took to the floor of the Senate to denounce the daughter of sharecroppers. "I feel compelled to rise on this issue to express, in the strongest terms, my opposition to the nomination of Janice Rogers Brown to the DC Circuit," Senator Obama said.

Born in segregated Alabama, Janice Rogers Brown had been a leftist like Obama before becoming conservative. When Obama rose to denounce the respected African-American jurist for her political views it had been almost a full two years since President Bush had nominated her in the summer of ’03.

Obama had arrived a few months earlier on his way to the White House and was eager to impress his left-wing backers with his political radicalism. He held forth complaining that Judge Janice Rogers Brown, who had gone to segregated schools and become the first African-American woman on the California Supreme Court, was guilty of “an unyielding belief in an unfettered free market.”

And he filibustered Judge Brown, along with other nominee, trying to deny them a vote.

“She has equated altruism with communism. She equates even the most modest efforts to level life's playing field with somehow inhibiting our liberty,” he fumed.

Brown, who due to her family background knew far more of slavery than Obama, had indeed warned about the dangers of a powerful government. "In the heyday of liberal democracy, all roads lead to slavery. And we no longer find slavery abhorrent. We embrace it. We demand more. Big government is not just the opiate of the masses. It is the opiate -- the drug of choice -- for multinational corporations and single moms, for regulated industries and rugged Midwestern farmers and militant senior citizens.”

Obama viewed her opposition to “our very own ‘Socialist revolution’” as disqualifying. Ideology was the only judicial test that ever mattered to him. Not scholarship. Not qualification. Not ability. He plots to force another radical nominee in place of the deceased Justice Scalia whom he had said would not have been nominated despite his “intellectual brilliance” because “he and I just disagree.”

When filibustering Justice Alito, Obama rejected the idea that the Senate should approve a judge just because he might be “intellectually capable and an all-around nice guy.” The key test was “ideology.” Justice Alito was an “an intelligent man and an accomplished jurist” who had the “the training and qualifications necessary to serve,” but he was from the wrong side of the political tracks.

And Obama put party over country and radical ideology over party.

He “profoundly” disagreed with Justice Clarence Thomas. He conceded that Justice Roberts “is qualified to sit on the highest court in the land” and that “he is humble, he is personally decent, and he appears to be respectful of different points of view,” but he voted against him because he has the wrong “political philosophy.”

It was all about politics. It was always about politics for Obama.

Democrats and their media allies demand a prompt and immediate “up and down vote” on his nominee.

But when Obama voted against Judge Priscilla Owen, despite her highest rating, Democrats had blocked her nomination for four years. That’s an entire presidential term. Owen was nominated by Bush in his first year in office. Despite being a moderate, Owen only got a full Senate vote during Bush’s second term. Obama had fought to filibuster her even though Owen was generally considered a moderate.

Obama filibustered Judge William Pryor, who had replaced Judge William Steele, who had never even gotten a hearing as part of a process that also took four years from first nomination to confirmation.

Bush had nominated Judge Pickering in ’01 and he was blocked in committee, falsely smeared as a racist and then filibustered by Senate Democrats to deny him the “up and down vote” that they are now busy clamoring for. After three years, Pickering gave up and was replaced by Wallace, who was also blocked by Senate Democrats for a year and denied a vote. Six years later, Bush was still trying with Judge Southwick who had served in Iraq. He was also denied an “up and down” vote until the end of 2007.

Senator Obama fought Judge Southwick’s nomination insisting on the need for a “consensus candidate” and claimed that his nomination would “threaten the very basis of our freedom and democracy.”

And only Obama was supposed to be allowed to do that.

By the time Senate Democrats finally approved a Bush nominee, a presidential term and a half had passed. Those numbers should put any of the current rhetoric about a “prompt process” and the right to an “up and down vote” to rest. If failing to move forward with a judicial nomination is a violation of the Constitution, then Obama and his political party were in violation of it under President Bush.

If it isn’t, then they are shameless liars who will say anything to get their way.

At their worst, Senate Democrats actually kept a judicial seat open for their choice, Judge Andre Davis, for Bush's entire two terms in office, by blocking all Republican nominees on one pretext on another until Obama took office. The seat stayed open not for a year or two or even six, but for nine years.

Senate Democrats have not only denied an “up and down vote” on Republican nominees for entire presidential terms, they have smeared them and destroyed their lives and even taken lives.

Judge Miguel Estrada’s nomination was blocked for years because, according to a memo from Senator Durbin’s office, he was “Latino,” in an ugly campaign that helped lead to the suicide of his wife. These are the rules by which the Democratic Party had played when the shoe was on the other foot.

And let’s not forget it.

Obama’s approach on both sides of the table was purely partisan. He now speaks about the importance of avoiding partisanship in judicial nominations, but his history of rhetoric and deeds tells another story.

The man in the White House is entitled to nominate only those judges he agrees with. But the Senate is equally entitled to approve them based on the same criteria. In the Senate, Obama approved judges based on partisan criteria. In the White House, he nominates judges based on partisan criteria.

Both of these behaviors are symptoms of his political extremism and inability to compromise. But even more troubling, his argument that Republican presidents and senators may not act the way that he did represents yet another fundamental breakdown of political equality under the rule of law.

Obama not only seeks to break the laws of the land, to make his own laws and then to demand that everyone abide by them, but he also wants a double standard in which these unique powers that he has claimed will be exclusive to his political movement. That goes beyond putting party ahead of country. It is the wholesale replacement of country with party and party with totalitarian ideology.

When he fought conservative judges based purely on ideology, Obama put party ahead of country. His judicial nominees were unqualified radicals who were manifestly hostile to the Constitution and put party ahead of country on the Supreme Court. Now Obama pleads with Republicans to put country ahead of party even while he schemes to once again find a way to put party ahead of country.

Indiana’s attempt to resist President Obama’s Syrian refugee program was sidetracked by a federal judge on Monday.
 
 
U.S. District Judge Tanya Walton Pratt issued a ruling in Indianapolis that said Gov. Mike Pence’s plan to bar state agencies from assisting in the process was discriminatory. The 36-page decision came as a result of a lawsuit filed by the American Civil Liberties Union in November on behalf of Exodus Refugee Immigration. The group has vetted 19 migrants for the U.S. government.
“[Pence’s order] clearly discriminates against Syrian refugees based on their national origin,” the judge wrote, the Associated Press reported.
 
The ACLU claims Pence’s order violates the U.S. Constitution and the Civil Rights Act by accepting refugees from other countries but not from Syria. The Republican governor made the decision after the Nov. 13, 2015, terror attacks in Paris, France, which killed 130. Islamic terrorism then struck San Bernardino, California, weeks later on Dec. 2, 2015, in plot that killed 14 at the the Inland Regional Center........

Rubio/Fox News Axis Exposed

There is more than one con man in this race for president.    Most certainly we can say that Trump’s supporters erroneously think he is Jeff Sessions on immigration and a conservative on some other issues, but even most of Rubio’s supporters have no idea how committed their candidate is to open borders. Rubio gets up at every debate and feigns outrage over the border and completely lies about his past. He has even said that his amnesty bill was never designed to pass. 

Anyone who fought this issue at the time remembers that Rubio promoted this bill with a presidential campaign-style media battle. The notion that he didn’t fight for open borders is as false as the notion that Rubio was responsible for getting rid of the “risk corridors” bailout in Obamacare. Now the New York Times is reporting that Rubio and Schumer collaborated with Fox News to lie to conservatives about the immigration bill in a full-throttle effort to get the bill passed:...It comes as no surprise that Murdoch would cheer on Rubio and Kasich. But notice how he added Trump to the list of those he deems acceptable in a general election. Guess who was left off that list? The one man the entire establishment hates and views as an existential threat to their existence: Ted Cruz......

Kasich’s Obamacare roadshow reaches Virginia

Ohio Gov. John Kasich spent several minutes of a Virginia campaign stop on Monday promoting Medicaid expansion.

Virginia is one of 19 states where lawmakers have rejected the funding the 2010 health insurance law promises for expanding Medicaid to working-age adults with no kids and no disabilities.

Democrat Gov. Terry McAuliffe supports Obamacare’s Medicaid expansion, and has borrowed many of Kasich’s talking points to pressure Virginia legislators to enact it.

In his Monday speech, Kasich suggested — as he has in Florida, Georgia, TennesseeNorth CarolinaSouth Carolina, South Dakota, and Montana — his fellow Republicans in the Old Dominion are fighting Obamacare because they are heartless politicians.




The Republican governor called Obamacare “bad medicine,” but he said the law’s Medicaid expansion gave him an opportunity to “bring 14 billion of our dollars home to deal with some serious problems.”

Kasich’s Obamacare expansion — paid for with new federal deficit spending — is on track to double his $14 billion cost estimate for 2014-20. Medicaid expansion is responsible for three-fourths of Ohio’s total Obamacare enrollment.

BACKGROUND: Gov. Kasich has a $14 billion Obamacare problem

Kasich framed Obamacare expansion as a program for the mentally ill, drug-addicted, and working poor, but it’s not targeted at any of those groups. Having income at or below 138 percent of the federal poverty line is the only requirement for Medicaid eligibility under Obamacare expansion.
Kasich noted, as he regularly does, that President Ronald Reagan expanded Medicaid; former Reagan chief of staff Ed Meese refuted Kasich’s insinuation that Reagan would support Obamacare in a 2013 National Review column.

Jeb Bush, the former Florida governor who suspended his presidential campaign after finishing fourth in South Carolina, began to sharply criticize Kasich’s embrace of Obamacare following Kasich’s second-place finish in the New Hampshire primary earlier this month.

Kasich, who came in fifth in South Carolina, alluded to Bush’s complaints while talking up Medicaid expansion in his Virginia stump speech.

“I knew I would take criticism. Did I care? Not really,” Kasich said, insisting mentally ill Ohioans are “living out their God-given purpose because of the resources we’ve been able to apply.”

“You know what I think? Our state grows, and as our state grows, we have an obligation — a responsibility as human beings all made in the image of the Lord — to help our fellow neighbors rise and be able to accomplish their purpose as well,” Kasich continued.

Kasich said on Feb. 3 that he doesn’t “go out and try to win a vote using God,” but he has persistently invoked God’s name to defend Obamacare expansion.

The governor has likewise been persistent in framing Obamacare expansion as a product of Ohio’s growing economy, part of his effort to convince voters the expansion isn’t paid for with new federal deficit spending.

BACKGROUND: Who’s paying for Kasich’s Medicaid expansion?

“But let me tell you this: if people want to attack me for that, great, because I wear it as a badge of honor in doing the right thing when everybody yells, ‘don’t do it, it’s bad politics,'” Kasich said. “We’ve had enough of politics in the United States of America. It’s time we had leadership and not politics.”

Back home in Ohio, Kasich’s Obamacare expansion is supported by the Ohio Hospital Association, the Ohio Chamber of Commerce, and every major newspaper. Like Kasich himself, the Ohio Republican Party supports the  expansion while claiming to be against the overall program.
When Kasich failed to lead the Ohio General Assembly to expand Medicaid in 2013, he vetoed a legislative ban on expansion, expanded Medicaid unilaterally, and threatened to bankrupt Ohio’s entire Medicaid program if a pseudo-legislative seven-member board didn’t appropriate Obamacare funding.

What Is the Fair Share of Taxes?

Presidential hopefuls Hillary Clinton and Sen. Bernie Sanders, along with President Obama, say they want high-income earners, otherwise known as the rich, to pay their fair share of income taxes. None of these people, as well as the uninformed in the media and our campus intellectual elites, will say precisely what is the 'fair share' of taxes. That is because they would look ignorant and silly, so they stick with simply saying that the rich should pay more. Let's you and I take a peek at who pays what in federal income taxes. The following represents 2012 income tax data recently released by the Internal Revenue Service, compiled by the Tax Foundation (http://tinyurl.com/j5yr8cd).

The top 1 percent, 1.37 million taxpayers earning $434,682 and more, paid 38 percent of all federal income taxes. The top 5 percent, those earning $175,817 and more, paid 59 percent. The top 10 percent of income earners, those earning $125,195 and up, paid 70 percent of all federal income taxes. The top 25 percent, those earning $73,354 and up, paid 86 percent. The bottom 50 percent, people earning $36,055 and less, paid a little less than 3 percent of federal income taxes. According to estimates by the Tax Policy Center, slightly over 45 percent of American households have no federal income tax liability....

FBI CAVES to terror-tied CAIR’s demands, SCRUBS anti-terror site of Islam and jihad

The FBI launched a new website to jihad terrorism but scrubbed it any references to Islam or Islamist extremism at the behest of terror-tied group CAIR.
Titled “Don’t be a Puppet,” the site originally had a significant emphasis on the main terrorism scourge plaguing today’s world – namely, extremist Islam. However, the Council on American-Islamic Relations (CAIR) – self-billed as “America’s largest Muslim civil liberties organization” and headquartered on Capitol Hill in Washington, D.C. – pressured the FBI, and all references to Islam were removed.

Trump's Insurgency

What's most surprising to many pundits and analysts is that Trump has done this without presenting all of the detail plans, voluminous position papers, etc. that we've come to expect over the last couple of decades. He has simply refused to play by those rules, and he's not paid a price for it.  Trump is able to pull this off because he's not running a political campaign.  Instead, he's running an insurgency.

The IMF Is the Dumpster Fire of the Global Economy

I thought the Organization for Economic Cooperation and Development had cemented its status as the world’s worst international bureaucracy when it called for a Keynesian spending binge even though the global economy is still suffering from previous schemes for government “stimulus.”
But the International Monetary Fund is causing me to reconsider my views.

First, some background about the IMF. Almost all of the problems occur when the political appointees at the top of the organization make policy choices. That’s when you get the IMF’s version of junk science, with laughable claims about inequality and growth, bizarrely inconsistent arguments about infrastructure spending, calls for massive energy taxes,

By contrast, you do get some worthwhile research from the career economists (on issues such as spending caps, fiscal decentralization, and the Laffer Curve).

But that kind of professional analysis gets almost no attention. The IMF’s grossly overpaid (and untaxed!) Managing Director seemingly devotes all her energy to pushing and publicizing bad policies.

The Wall Street Journal reports, for instance, that the IMF is following the OECD down the primrose path of fiscal recklessness and is also urging nations to throw good money after bad with another Keynesian spending spree.
The world’s largest economies should agree to a coordinated increase in government spending to counter the growing risk of a deeper global economic slowdown, the International Monetary Fund said Wednesday. …the IMF is pushing G-20 finance ministers and central bankers meeting in Shanghai later this week to agree on bold new commitments for public spending.
Fortunately, at least one major economy seems uninterested in the IMF’s snake-oil medicine.
The IMF’s calls will face some resistance in Shanghai. Fiscal hawk Germany has been reluctant to heed long-issued calls by the U.S., the IMF and others to help boost the eurozone’s weak recovery with public spending.
Hooray for the Germans. I don’t particularly like fiscal policy in that nation, but I at least give the Germans credit for understanding at the end of the day that 2 + 2 = 4.
I’m also hoping the British government, which is being pressured by the IMF, also resists pressure to adopt Dr. Kevorkian economic policy.
The International Monetary Fund has urged the UK to ease back on austerity… IMF officials said the Treasury had done enough to stabilise the government’s finances for it to embark on extra investment spending… The Treasury declined to comment on the IMF report. The report said: “Flexibility in the fiscal framework should be used to modify the pace of adjustment in the event of weaker demand growth.” …Osborne has resisted attempts to coordinate spending by G20 countries to boost growth, preferring to focus on reducing the deficit in public spending to achieve a balanced budget by 2020.
But you’ll be happy to know the IMF doesn’t discriminate.
It balances out calls for bad policy in the developed world with calls for bad policy in other places as well. And the one constant theme is that taxes always should be increased.


I wrote last year about how the IMF wants to sabotage China’s economy with tax hikes.

Well, here are some excerpts from a Dow Jones report on the IMF proposing higher tax burdens, tax harmonization, and bigger government in the Middle East.
The head of the International Monetary Fund on Monday urged energy exporters of the Middle East to raise more taxes… “These economies need to strengthen their fiscal frameworks…by boosting non-hydrocarbon sources of revenues,” Christine Lagarde said at a finance forum in the United Arab Emirates capital. …Ms. Lagarde called on the Persian Gulf states to introduce a valued added tax, which, even at a relatively low rate, could lift gross domestic product by 2%, she said. …Ms. Lagarde, who on Friday clinched a second five-year term as the IMF’s managing director, also urged governments in the region to consider raising corporate income taxes and even prepare for personal income taxes. Income taxes in particular could prove a sensitive move in the Gulf, which in recent decades has attracted millions of workers from abroad by offering, among other things, light-touch tax regimes. Ms. Lagarde also wants to discourage “overly aggressive tax competition” among countries that allow international companies and wealthy individuals to shift their wealth to lower tax destinations.
Wow, Ms. Lagarde may be the world’s most government-centric person, putting even Bernie Sanders in her dust.

She managed, in a single speech, to argue that higher taxes “strengthen…fiscal frameworks” even though that approach eventually leads to massive fiscal instability. She also apparently claimed that a value-added tax could boost economic output, an idea so utterly absurd that I hope the reporter simply mischaracterized her comments and that instead she merely asserted that a VAT could transfer an additional 2 percent of the economy’s output into government coffers. And she even urged the imposition of income taxes, which almost certainly would be a recipe for turning thriving economies such as Dubai back into backward jurisdictions where prosperity is limited to the oil-dependent ruling class.

And it goes without saying that the IMF wants to export bad policy to every corner of the world.
The IMF chief said taxation allows governments to mobilize their revenues. She noted, however, that the process can be undermined by “overly aggressive tax competition” among countries, and companies abusing the system of international taxation. …She argued that the automatic exchange of taxpayer information among governments could make it harder for businesses to follow the scheme.
And don’t forget that the IMF oftentimes will offer countries money to implement bad policy, like when the bureaucrats bribed Albania to get rid of its flat tax.

P.S. Now perhaps you’ll understand why I was so disappointed that last year’s budget deal included a provision to expand the IMF’s authority to push bad policy around the world.

P.P.S. In other words, American taxpayers are being forced to subsidize the IMF so it can advocate higher taxes on American taxpayers! Sort of like having to buy a gun for the robber who wants to steal your money.

P.P.P.S. Though I’ll also be grateful that the IMF inadvertently and accidentally provided some very powerful data against the value-added tax.

Obama’s climate change legacy to be determined by next president

After months of debate and public comments, President Obama’s controversial Clean Power Plan (CPP) was issued in August 2015 and published in the Federal Register on October 23, 2015. But that is hardly the end of the story. Instead the saga is just beginning—with the ending to be written sometime in 2017 and the outcome highly dependent on who resides in the White House.

The CPP is the newest set of Environmental Protection Agency (EPA) regulations that the Atlantic states: “anchors the Obama administration’s climate-change policy. It seeks to guide local utilities away from coal-fired electricity generation, and toward renewable energy and natural gas”—with a goal of reducing CO2 emissions from existing power plants by 32 percent from 2005 levels by 2030. States are required to submit implementations plans by September 6, 2016 with emission reductions scheduled to begin on January 1, 2022.

Immediately following the rule’s publication, a coalition of 24 states and a coal mining company, led by West Virginia Attorney General Patrick Morrisey (R), filed a lawsuit to challenge the CPP. Morrisey called it: “flatly illegal and one of the most aggressive executive branch power grabs we’ve seen in a long time.”

The Hill reports: “They are asking the Court of Appeals for the District of Columbia Circuit to overturn the rule. They also want the court to immediately stop its implementation while it works its way through the courts.” Differing from the Cincinnati-based Court of Appeals for the Sixth Circuit that in October issued a stay for the Waters of the U.S. rule, on January 21, 2016, the federal court refused to put a hold on the CPP while the litigation proceeds. It did, however, agree to expedite the case with oral arguments beginning on June 2.

Days later, January 26, in an unusual move, the petitioners—which now include 29 states (Nevada is the latest to oppose CPP, to protect “Nevada’s vital tourism industry.” On February 24, Attorney General Laxalt filed a brief to highlight the federal agency’s overreach and disregard for the rule of law associated with CPP.) and a large group of utility companies and energy industry trade groups—turned to the Supreme Court (SCOTUS). Morrisey acknowledged: “While we know a stay request to the Supreme Court isn’t typical at this stage of the proceedings, we must pursue this option to mitigate further damage from this rule.” Knowing that SCOTUS has never before engaged in a case before a federal court even heard the initial arguments, CPP supporters, like Sierra Club Chief Climate Counsel Joanne Spalding, apparently felt confident, calling the appeal: “another ‘Hail Mary’ challenge to the Clean Power Plan.”

Citing SCOTUS’ 2015 ruling that reversed the Mercury Air Toxics Standards (MATS) rule, petitioners argued that the damage from MATS had already been done by the time the decision came down. In a Client Alert, international law firm Milbank—which works in the energy space—said: “The EPA itself acknowledged that the ruling had virtually no impact, as states had already largely complied with the regulation by the time the Court’s order was issued.”

Despite the historic nature of the request, on February 9, in a 5 to 4 majority, SCOTUS granted an emergency stay of CPP. Milbank states: “The issuance of stay signaled that five of the Supreme Court justices had significant reservations about the EPA’s attempt to regulate emissions from power plants in the way the CPP is currently designed. To grant the stay, the Supreme Court must have found that there was a ‘fair prospect’ that a majority of the Court would vote to reverse a judgment if the D.C. Circuit were to uphold the CPP.” Morrisey agrees: “the decision reinforces confidence in the broader challenge as the Supreme Court found the coalition’s arguments strong enough to stop the EPA even before the lawsuit concludes.” The victory means the EPA is prohibited from implementing or enforcing the CPP until the D.C. Circuit issues a decision on the challenge—which is expected as early as this fall. FuelFix reports: “The conventional wisdom is the three-member court panel will rule favorably for the White House.”

As 18 states opposed the application for the stay, whatever decision the lower court reaches, most experts agree SCOTUS will eventually hear the case—likely in 2017.

CPP opponents saw the stay as a sign SCOTUS might strike down the rule. Seth Jaffe, a former president of the American College of Environmental Lawyers, according to the Atlantic, sees it as an “ominous sign for the regulations.” Jaffe said: “One has to conclude that five justices have decided that the rule must go.”

Confidence ebbed, however, with the death of Justice Antonin Scalia—just four days after the court’s unprecedented stay order. As a conservative voice on the court, Scalia had a history of limiting government regulation and was a scathing critic of EPA’s regulation of greenhouse gas emissions. Depending on who fills the empty seat, and when, the court’s decision could go one way or the other.

Regardless, the EPA is continuing to move forward and is encouraging states to take voluntary steps toward compliance and is supporting those who do.

States have reacted differently to the stay. Many states, such as Massachusetts, Arizona, and Virginia are moving ahead with their plans. Some are already well into their CPP compliance plans, with California expected to submit its plan ahead of schedule. Ohio Public Utility Commissioner Asim Haque, reports that they were “already close to completion,” but the commission has put analysis on hold for now.

Texas, whose Attorney General Ken Paxton (R) shared the lead with Morrisey on requesting the stay, is in a holding pattern. Toby Baker, a commissioner on the Texas Commission on Environmental Quality, according to FuelFix, said: “I’ve watched states get in front of their skis on federal regulations, and then the regulations come out and they don’t match. I do feel like the [clean power plan] will change from what it is right now.”

Following the SCOTUS decision, Wisconsin Governor Scott Walker (R) issued an executive order prohibiting state agencies from doing any work to prepare for the CPP until the stay expires. Citing “undue burden” on state ratepayers and manufacturers, he argued that the rule could have a “devastating impact.”

Because the SCOTUS stay halts enforcement of the CPP until the court challenge concludes, and delays the EPA’s deadlines, Morrisey and Paxton, in a February 12 letter to the National Association of Regulatory Utility Commissioners and the National Association of Clean Air Agencies, encouraged them to “put their pencils down.” They point out: states “have no legal obligation to continue with spending taxpayer funds on compliance efforts for a suspended and likely unlawful Power Plan. …Any taxpayer dollars spent during the judicial review process are unnecessary and likely to be entirely wasted.”

Pennsylvania Coal Alliance CEO John Pippy, a leading advocate for the coal industry in his state, argues that there are “serious concerns regarding the resources that will be wasted attempting to develop a compliance plan, at the expense of the taxpayers, for a rule that may be significantly altered or thrown out by the Federal Courts.”

With the court challenge coming up in a few months, last week, February 23, led by Senate Majority Leader Mitch McConnell (R-KY) and Senate EPW Committee Chairman James Inhofe (R-OK), 34 Senators and 171 Representatives filed an amicus brief urging the Circuit Court to “block the EPA’s attempts to transform the nation’s electricity sector.” As the press release states, the lawmakers believe the rule “goes well beyond the clear statutory directive.” It points out: “States will face unprecedented new regulatory burdens, electricity ratepayers will be subject to billions of dollars in compliance costs, and American workers and their families will experience the hardship of job losses due to power plant shutdowns, higher electricity prices, and overall diminishment of the nation’s global economic competitiveness.”

Congressman Kevin Cramer (R-ND) says he joined his colleagues in filing the brief because “The EPA’s actions are clearly illegal and violate the expressed intent of Congress.” He sees that his state has been singled out. The initial proposed rule required South Dakota to reduce emissions by 11 percent, but the final rule required a “detrimental 45 percent.” Cramer concludes: “North Dakota’s electricity producers provide some of the most affordable electricity and maintain some of the cleanest air, but this Admiration’s focus on implementing a radical environmental agenda threatens our economic future.”

Now, we wait for the CPP to make its way through the courts—first the D.C. Circuit Court and then, in 2017, the Supreme Court. But, since the CPP is on hold until at least 2017, its future will really be decided by the next president. Milbank states: “the next administration could seek to alter, cease or continue efforts to implement the existing CPP. Should a Republican reach the Oval Office, this could result in a permanent halt of the EPA’s implementation of the plan altogether, or a significant departure from current emission reduction targets. Yet, should a Democrat be elected, the new administration could push forward with the CPP while exploring additional provisions of the Clean Air Act.”

Of course, as things stand now, the next president will be appointing Justice Scalia’s replacement. “If a Republican wins the White House, the Atlantic observes, “their nominee would almost certainly join the Supreme Court’s conservative wing. That justice would be unlikely to vote to support the Clean Power Plan—but it wouldn’t matter, because no remaining Republican supports Obama’s climate policies, anyway, so they’d likely be reversed administratively.”

With a Republican president, there’ll be other changes that could impact the CPP. The EPA, should it not be eliminated, will have a new Administrator. Gina McCarthy will no longer be in charge and influencing policy. If the CPP were actually argued before the court, it would be under the guidance of new leadership and could be presented in a very different way.

Since the CPP will not be argued in the Supreme Court until 2017, when the next president will be in office, it really is the winner on November 8, 2016, who determines the legal battle of the CPP—which will either embrace or eradicate Obama’s climate change policies and the Paris Agreement. Considering the CPP will, as Morrisey pleads, cause “even more destruction of untold number of jobs, skyrocketing electricity bills and the weakening of the nation’s electric grid,” the stakes couldn’t be higher.

Scientists Have Sequenced the Genome of the Tick that Transmits Lyme Disease

An international team of scientists led by Purdue University has sequenced the genome of the tick that transmits Lyme disease, the most common vector-borne illness in North America. Ixodes scapularis, known as the blacklegged tick or the deer tick, is the first tick species to have its genome sequenced.

The decade-long project, involving 93 authors from 46 institutions, decodes the biology of an arachnid with sophisticated spit, barbed mouthparts, and millions of years of successful parasitism. My Take - I believe this is going to be the wave of the future.  Genetic pest control.  Products that are so target specific they won't even have a signal word.  For those who don't understand about pesticides - there are three signal words used on pesticide labels.  Danger Skull and Crossbones, Warning and Caution is used twice.  If a pesticide only kills one pest - there's no need for a warning on the label as it has no impact on any other life form.  We already have a Termiticide that fills that category, and that's where a great deal of research is heading.  We can look to pharmaceuticals to go in the same direction.  Genetically modification is the wave of the future - and I think it's a bright one....and it better be because viruses can get out of control easily and we're running out of effective antibiotics for many afflictions such as tuberculosis.   So stop listening to these insane activists who have no idea what they're talking about.

What the Campus Crybully Wars Are Really About

The campus wars aren’t really about race. Race and the rest of the identity politics roster are the engine for transforming an academic environment into an activist environment.
The average campus already skews left, but it maintains the pretense of serving an educational purpose. The demands put forward on various campuses begin with racial privileges, but do not end there. These demands call for politicizing every department, the mandatory political indoctrination of all students and faculty, and the submission of non-political academic departments to activist political ones.

The campus wars are a declaration that activist non-academic departments that offer identity politics analysis while contributing nothing and which often owe their existence to campus clashes from a previous generation, should dominate all areas of life and thought at every university......Safe space culture would silence dissent among faculty and students while creating activist student-faculty organizations empowered to conduct an endless cycle of purges and protests. College would be free and utterly useless for anything except turning out the next generation of community organizers. It is not only the ideas themselves that are endangered, but the entire mechanism for exchanging them.
The activist model would not only eliminate intellectual diversity, it would eliminate education.
The campus wars are about political correctness as a way of life. Inside every crybully wailing about their fragility is a totalitarian screaming to be put in charge of every single professor and student.

While the West debates the humanitarian problem of Syrian refugees flooding across its borders, the discussions repeatedly turn to the dangers they might pose: what if there are terrorists among them? How can we be sure? How can we save those in need of saving and still be safe ourselves?
Yet for many of these refugees, married off against their will, the terror has already begun. They are 11 and 13 and 14 years old. Some of them are pregnant. Some are already mothers at 14. Their husbands are 25 or 38 or 40. And there is no escape.

"Child marriage existed in Syria before the start of the conflict," reports Girls Not Brides, a global partnership aimed at ending child marriage worldwide, "but the onset of war and the mass displacement of millions of refugees has led to a dramatic rise in the number of girls married as children."

Indeed, since the start of the refugee crisis, UNICEF reports, as many as "one-third of registered marriages among Syrian refugees in Jordan between January and March 2014 involved girls under 18," with some as young as 11.
 


The New California Crime Wave

Something amazing has happened in California. First, a brief background: Crime rates across the state, after a long period of steady decline, had reached fifty-year lows in 2014. Then, that November, a 60 percent majority of California voters—presumably incapable of accepting such good news without a measure of collective guilt—decided that it would be a really enlightened idea to pass Proposition 47, a ballot initiative bearing the cheery name “The Safe Neighborhoods and Schools Act.”

The purpose of this measure was to downgrade many types of drug possession and property crimes from felonies (punishable by more than a year in prison) to misdemeanors (which often entail no prison time at all). For the benefit of squeamish skeptics, the self-assured proponents of Prop 47 condescended to explain that these reduced penalties would not only alleviate prison overcrowding, but would also make California's streets safer by placing drug offenders into warm-and-fuzzy treatment and counseling programs, rather than into disagreeable prison cells. If you think this sounds like a familiar old tune, you're quite correct. It was #1 on the left-wing hit parade throughout the 1960s, when it became the theme song of skyrocketing crime rates across the United States. And now the Golden Oldie is back, in the Golden State.

The tangible results of Prop 47 were both immediate and breathtaking. Within a year, there were some 14,000 fewer inmates in California's state prisons and local jails, just as the Proposition's backers had promised......."Proposition 47, it's cool,” Semisi chirps. “Like for me, I can go do a burglary and know that if it's not over $900, they'll just give me a ticket and let me go.”  Ain't “criminal justice reform” grand?......

US appeals court: Terror victims can seize $9.4 million of Iran funds

“Iran needs to understand that these court judgments have not been canceled and that the terror victims will continue to pursue them in legal forums all over the world," attorney says." Victims of a 1997 triple suicide bombing in Jerusalem have won a major US appeals court judgment involving an award of $9.4 million in damages. The Ninth Circuit Appellate Court, which handles appeals from California court decisions, handed down the judgment on Friday in favor of a group of victims represented by Shurat Hadin’s Nitsana Darshan-Leitner in Israel, and by David Strachman of Rhode Island as US counsel. The attack in question took place on September 4, 1997, when three terrorists set off explosives attached to their bodies as they wandered into the packed Ben-Yehuda pedestrian mall in the middle of the afternoon, killing five Israelis and wounding scores more. Three of those killed were 14-year-old girls.....

Student protesters swarmed California State University, Los Angeles to barricade the entrances of a theater where conservative commentator Ben Shapiro was set to deliver a speech about censorship and diversity on college campuses.  Led primarily by the school’s Black Student Union and Black Lives Matter chapter, the hundreds of demonstrators, including some professors, poured into the Student Union building Thursday afternoon to block other students from attending the event. Many in the dense crowd of protesters shoved and shouted at attendees who tried slipping through the doors.  Members of the conservative Young America’s Foundation, host of the event, called “When Diversity Becomes a Problem,” said they were forced to sneak groups of four to five in the back door leading directly to the theater to avoid catching the attention of protesters who hadn’t yet obstructed the last entrance.....
