EPA's Federal Plan Would Force States Into Cap-and-Trade Scheme
The Buckeye Institute files formal comments challenging legality of this federal overreach
COLUMBUS, OHIO--The Buckeye Institute filed comments Thursday challenging the legality of the U.S. Environmental Protection Agency's (EPA) proposed "federal plan" to regulate carbon dioxide emissions under President Obama's Clean Power Plan.
The Buckeye Institute joined the Competitive Enterprise Institute and several other state-level free market think tanks to criticize the EPA's plan, which is a national cap-and-trade program that Congress has explicitly rejected many times. The EPA says it will enforce its federal plan if a state fails to submit its own compliance plan or submits a plan that EPA thinks isn't good enough.
"This federal plan is another example of the Administration using executive overreach to bypass Congress and ignore the best interests of the American people," said William & Helen Diehl Energy and Transparency Fellow Joe Nichols. "EPA claims this rule gives states 'flexibility' to comply, but it is really a backdoor effort to force the states into a costly cap-and-trade scheme."
The filing was submitted to the EPA before a regulatory deadline for outside parties to comment on the agency's sweeping new rule. The Buckeye Institute joined the Texas Public Policy Foundation to file comments opposing the regulation on legal and economic grounds as well.
