Senate committee to hold hearing on civil asset forfeiture reform bill

Mandrel Stuart and his young attorney found out firsthand the power of law enforcement to take what it wants through civil asset forfeiture.  In August 2012, Stuart was pulled over on suspicion of a minor traffic violation. Although he was never charged with a crime, the cops seized $17,550 Stuart had with him. The owner of a small barbecue joint in Maryland, Stuart was trying to get his life on track after some past run-ins with the law.  The $17,550 was his earnings from the restaurant, money he intended to put toward supplies and equipment. Stuart’s past made credit nearly impossible to obtain, so cash was the only currency of his business.

He finally got the money back — 14 months after it was confiscated. By that time, with no cash to cover the cost of his overhead, Stuart’s barbecue joint was long gone.
Along the way, Stuart resisted a settlement offer from prosecutors who said they would return half of his cash.  “I paid taxes on that money. I worked for that money,” Stuart told The Washington Post. “Why should I give them my money?”...

My Take - The argument cited in the article to justify this criminal activity by government agents is "nobody carries that kind of money around…anymore, so it has to be illegal."  Well, first of all that's not true, but secondly - even if it were true it's their job to charge them with a crime, indict them with a grand jury, send the case to trial and either convict or release them - not to confiscate their assets without going through that process. A process designed to protect the innocent and punish the guilty by making sure a crime has actaully been committed.  There's nothing in the Constitution that allows government to ignore those foundational rights.  If there ever was a more blatantly unconstitutional action by the federal govenment and the states I don't know what it is.   

Why Do Hillary Clinton and Bernie Sanders Want to Undermine Jobs and Investment in America?

What’s the difference between Bernie Sanders and Hillary Clinton?

I suspect that most people would cite differences in personal ethics, but I’m a policy wonk so I actually think the leading candidates for the Democratic presidential nomination are two peas in a pod.

The only real difference is that Sanders is more open about his statist beliefs and is more anxious to adopt bad policies as quickly as possible.

But since I don’t want to become Greece, I have a hard time being impressed by politicians who bicker about the best route and best speed to get to the wrong destination.

Consider, for example, their views on corporate taxation. And let’s look specifically at the issue of how to deal with corporate inversions.

First, some background. The Wall Street Journal opines about the logical argument – and fiduciary obligation – for companies to escape America’s awful corporate tax system.
A major U.S. company merges with a foreign firm in part to avoid America’s punishing corporate tax code, and the politicians who refuse to reform the code denounce the company for trying to stay competitive. …Sigh. …Let’s try to explain one more time why it makes perfect business—and moral—sense… The U.S. federal corporate income tax rate is 35%. The Irish rate is 12.5%. …A CEO obliged to act in the best interests of shareholders cannot ignore this competitive reality.
All this makes great sense, and I’ve made similar arguments.

But what do Sanders and Clinton think? Well, the editorial skewers the two leading Democratic candidates for their vacuous demagoguery.
…none of this business logic impresses Hillary Clinton or Bernie Sanders, who helped to write the U.S. tax code as Senators but are now competing as presidential candidates to see who can demagogue more ferociously against American employers.Neither one wants to reform the tax code to make U.S. tax rates more competitive with the rest of the world. Instead they want to raise the costs of doing business even further. Mrs. Clinton’s solution is to raise taxes on investors with higher capital-gains taxes, block inversion deals, and apply an “exit tax” to businesses that manage to escape. Mr. Sanders would go further and perform an immediate $620 billion cashectomy on U.S. companies. The Vermonter would tax the money U.S. firms have earned overseas, even though that income has already been taxed in foreign jurisdictions.
Call me crazy, but I don’t think the ideas being peddled by Clinton and Sanders will lead to more and better jobs in the United States.

Which is why, when given the chance to  write about this topic for Fortune, I suggested that it would be best to actually fix the tax code rather than blaming the victim.
Some U.S. politicians respond to these mergers with demagoguery about “economic treason,” but that’s silly. These corporate unions are basically the business version of a couple in a long-distance relationship that decides to live where the economic outlook is brighter after getting married. So instead of blaming the victims, the folks in Washington should do what’s right for the country by trying to deal with the warts that make America’s tax system so unappealing for multinational firms.
And what are those warts?

The same ones any sensible person would identify. First, America’s corporate tax rate is absurdly anti-competitive.
With a 35% levy from Washington, augmented by smaller state corporate taxes, the combined burden is more than 39%. In Europe, by contrast, the average corporate tax rate has now dropped below 24%. And the average corporate rate for Asia’s major economies is even lower.
Second, we have a peculiarly self-destructive practice of wanting to tax income earned in other countries.
…the IRS also imposes tax on income earned in other nations. Very few nations impose a system of “worldwide taxation,” mostly for the simple reason that the income already is subject to tax in the nations where it is earned.
So here’s the bottom line.
The combination of a high rate and worldwide taxation is like a one-two punch against the competitiveness of U.S.-domiciled firms, so it’s easy to understand why inversions are so attractive. They’re a very simple step to protect the interests of workers, consumers and shareholders. …Let’s hope politicians put aside class warfare and anti-business demagoguery and fix the tax system before it’s too late.
By the way, even a columnist for the New York Times agrees with me. He has a piece on the inversion issue that is not very favorable to companies, and it certainly reads like he’s in favor of governments having more money, but he can’t help but come to the right conclusion.
Ultimately, the only way inversions will stop is when the corporate tax code changes so it becomes more attractive for American companies to be American companies.
And I can’t resist closing with a great blurb from George Will’s most recent column.
Having already paid taxes on it where it was earned, the corporations sensibly resist having it taxed again by the United States’ corporate tax, the highest in the industrial world.
Amen.

Will succinctly brings together the two most important things to understand about this issue. First, the income earned by American companies in other nations already is subject to tax, and, second, companies understandably don’t want it taxed again by the world’s highest corporate tax rate.
P.S. I’ve made the serious point that Sanders isn’t really a socialist, at least based on his voting record and what he proposes today. Instead, he’s just a conventional statist with mainstream (among leftists) views about redistribution.

Yet because he calls himself a socialist, that leads to amusing moments when other Democrats are asked to identify how he’s different. I’ve already mocked Debbie Wasserman Schultz for her inability to answer that question.

Now let’s see Hillary Clinton dance and dodge. The parts worth watching are all in the first half of the video.



Too bad Chris Matthews didn’t actually press her to answer the question. Though I’m vaguely impressed that she actually knows there are such a thing as libertarians.

P.P.S. While Hillary is clueless, there’s another Clinton that actually has some semi-sensible views about corporate taxation.

NYT Issues 315-Word Correction on Article Slamming Israel

The New York Times appended a lengthy correction apologizing for and explaining multiple errors and omissions in a recent article claiming that Jewish people are evicting Palestinians from their homes in Jerusalem.  The article, which sought to portray several Jewish organizations as pariah groups seeking to put Palestinian families out on the streets, was “incomplete,” relying only on stories and facts presented by Palestinians. It turns out these Palestinian families did not tell the whole truth, according to the correction. Obama Administration Orders Labeling of Israeli Goods

Memo directs ‘trade community’ to label Jewish goods

A memo issued earlier this month by the Obama administration directs the U.S. “trade community” and government partner agencies to explicitly label Israeli-made goods that have been produced in the West Bank.  The Jan. 23 directive states that it is “not acceptable” to label goods coming from Israeli companies in the West Bank and Gaza Strip as having been produced in “Israel.”

The order comes amid an effort by the European Union to label Israeli-made goods, a move the Israeli government called anti-Israel and that prominent anti-Semitism watchdog groups have condemned as among the worst incidents of anti-Semitism in 2015.  This is a shift from the administration’s previous position. A State Department spokesman told reporters in November that such labeling could be perceived as “a step on the way to a boycott” and said boycotts would be opposed by the administration.  But earlier this month, senior Obama administration officials defended the EU’s move and reaffirmed its position against “Israeli settlement activity.”...

Don't Be Fooled. The Law Didn't Require This Texas DA to Slap the Planned Parenthood Sting Videographers with Felonies

David Daleiden and Susan Merritt's sting videos revealed that Planned Parenthood was likely committing felonies at the Gulf Coast Planned Parenthood in Houston by selling fetal body parts for profit. But the Harris County District Attorney, Devon Anderson, brought charges not against Planned Parenthood but against Daleiden, Merritt and their Center for Medical Progress.

The move raised more than a few eyebrows, and Anderson, elected in 2014 with the endorsement of Texas Right to Life, has now released a short video insisting that she and the grand jury were driven to issue the draconian charges by the strictures of law and ethics. If you don't have a background in the law, her explanation sounds persuasive. The Department of Labor is seeking to remove the terms “he” and “she” from a regulation prohibiting discrimination in the workforce in an effort to “avoid the gender binary.”  The agency is also adding “sex stereotyping, transgender status, and gender identity” to the list of types of employment discrimination banned under the Workforce Innovation and Opportunity Act. Special Ops Commander Demands Pentagon Stop Exposing Operations

The annual World Economic Forum meeting in Davos, Switzerland, has just wrapped up after a focus on a “Fourth Industrial Revolution” and other issues the global elites consider important to the entire world community.  But an insider who once set up such conferences, has held a United Nations post, mingled with the top players in Washington and lists multiple foundation board memberships on his resume warns “old-fashioned values” are being left behind.
 
“I think we’re moving in the direction of more and more globalism, which I would distinguish from globalization, which is more an integrated kind of trading and investment pattern,” said Theodore Roosevelt Malloch.  He said the elites’ discussions of problems and solutions have taken on a global tone, as epitomized by Davos.  “There’s more and more emphasis, particularly in the developing world and in Europe, not necessarily in the U.S., unless you consider the Obama administration indicative of the emphasis, on one-world solutions, on UN solutions, on unitary solutions,” Malloch said.

My Take - Drip, drip, drip - and then all of a sudden you have a lot of water. This should have been obvious to the most casual observer, but as it is - only those who've been watching, paying attention and observing the drops accumulate toward a goal that's been in the works since the late 1800's.  The average person is a bit shocked when this is brought up, and I will tell you this: The average person will go along to get along, just as we see happening with the imposition of Sharia law in western culture, in the U.S. Military and the federal government.

The world is in far deeper trouble than most realize.  In my opinion by 2020 the world's economy will start to collapse, and by 2025 the world will be in the throes of an economic disaster so severe there will be wars, civil wars, terrorism, riots, governments overturned and whole countries like Greece will cease to exist.  Theft, rape and murder and all forms of criminal activity will escalate on a scale worldwide, terrifying everyone.....except these elites. 

These events will be the excuse they need to form a world government under the auspices of the United Nations.  Eliminating the only beacon of freedom and hope in the world - the U.S. Constitution.  And the media and public will support this move.  Then the world - it's economy, resources, lands, seas and military will be in the hands of the same corrupt incompetents who brought us all to where we are now.

Ted Kennedy once said the only reason socialism didn't work anywhere in the world was because he wasn't running it.  This from a guy who couldn't be bothered to save a young woman, Mary Jo Kopechne, from drowning after drinking, driving and crashing his car.   Ted Kennedy was the perfect reflection of leftism.

Hillary's Parade is Over: Part VII

I don't think any news service in the world has been more devoted to exposing the Clinton's corruption than World Net Daily.  The list of their reporting is amazingly extensive - and I thought it might be worthwhile to organize their reporting of the Clinton's history - especially Hillary's - by topic, or at least as much as possible. Some articles I thought inappropriate and they were left out, and even then - there is much here I found unpleasant to post.  It's one thing to watch the Clintons over the years and see what they've done, but to see all this in one sitting is a little bit unnerving.   If someone read this who didn't know anything about the Clintons they would be incredulous.  For those who do know about the Clintons they're going to feel incredulous wanting to ask: Can all this be true?

Some of the articles are posted twice because the information is appropriate for each category.  I think you will find this way beyond interesting! 

There are two absolutely clear understandings you will come away with:  WND really doesn't like the Clintons and considering the amount of scandal surrounding the them that's not startling.  The disdain is understandable.

In no other time in modern American history could such a candidate last more than a nanosecond before being dumped by the party in no uncertain terms.  There were some real stinkers in the 19th century, but Hillary takes the cake. 

One more thing has occurred to me.  This is going to be a nightmare for Obama and his whole pack of myrmidons because if she goes down she won't go down alone.  There will be those who will be sacrificed to try and save her and those who will be sacrificed because she wasn't saved, and her husband may join her.  The Clintons will not go down alone. To do otherwise would be un-Clinton-like! 

There is one more thing I think is clear.  I am of the opinion the Clinton Foundation - seemingly corrupt as is claimed - would have never been exposed if she had happily stayed a Senator from New York and then gone off into the sunset stunningly rich and happy as a clam.  Of course the question arises: Would the Clinton Foundation gotten all that money if they weren't in power and having it for sale?  But either way - the exposure came because she had to show she had experience in foreign affairs to prove she deserved to be President of the United States.  But her stint as Secretary of State has exposed her as incompetent, corrupt and  most importantly - shocker of shockers - she's clearly not the smartest woman in the world, and now the Clinton Foundation may be - if the corruption is shown to be true - justifiably dismantled and people sent to jail. 

Arrogance has it's price.

Clinton's testimony on Benghazi security contradicted by Pentagon - A central part of Hillary Clinton’s testimony to the legislative committee investigating the Benghazi attack is directly contradicted by the Pentagon expert who led the U.S. military’s efforts to supplement diplomatic security in Libya.  Repeating an assertion she has previously made, Clinton stated unequivocally at Thursday’s hearing that there were no recommendations from anyone within the government to close the U.S. special mission in Benghazi despite  security threats.
 
Dems bemoan 'political' Benghazi probe of Hillary - In dueling opening statements, Rep. Trey Gowdy, R-S.C., chairman of the House Select Committee on Benghazi, and ranking member Elijah Cummings, D-Md., preceded the much-awaited testimony of former Secretary of State Hillary Clinton with a debate over whether the hearing was a pursuit for the truth of what happened in the Sept. 11, 2012, attack that killed U.S. Ambassador Christopher Stevens or a Republican witch hunt designed to derail Clinton’s presidential ambitions.
 
Trey Gowdy slams CNN for 'fabulist' Benghazi report - Bradley Podliska, a former staffer with the House Select Benghazi Committee who helped with the investigation of that fateful 2012 attack, said he was fired from his Capitol Hill role because he refused to target Hillary Clinton, former secretary of State.  But his words were met with speedy rebuttal from one of Benghazi’s key investigators, Rep. Trey Gowdy.  Podliska said during an interview on CNN with Jake Tapper: “I was fired for trying to conduct an objective nonpartisan, thorough investigation.”
 
Benghazi details found in Hillary Clinton's emails -  More details have emerged about emails from former Secretary of State Hillary Clinton’s private server, including that there was classified material from five different agencies and among the information were discussions about the situation in Benghazi, in which terrorists attacked a U.S. facility and killed four Americans. Then the Obama administration dispatched officials to various television programs to claim it was a sudden violent response to an obscure online video.The new details were released by McClatchy, which found that the Benghazi email was among those released to the public in May by the State Department.

State Dept. to Hillary lawyer: Destroy classified Benghazi email - Another jolting disclosure in the Hillary Clinton email scandal: The State Department asked her lawyer to destroy all electronic copies of an email with classified information on the Benghazi terrorist attack. Clinton attorney David Kendall refused the request from Under Secretary of State for Management Patrick F. Kennedy, citing requests by Congress and other investigators to preserve her records, but he suggested the email might be deleted at some point.
 
Rand Paul launches into Hillary - During a radio interview Sunday, U.S. Sen. Rand Paul, a Republican presidential candidate, blasted Hillary Clinton over the email scandal, arguing her judgment in the fiasco shows she lacks the “wisdom” to control the U.S. nuclear arsenal as president.  “I think without question she put the country at risk,” Paul said. “She put her safety at risk. She put the people who protect her at risk by using a server that was not a secure national security type of server.”
 
Rand Paul: Hillary 'dishonest' during Benghazi testimony - Sen. Rand Paul, R-Ky., charged during a radio interview on Sunday that Hillary Clinton was “dishonest” during her testimony before a Senate hearing on Benghazi.   During the Benghazi hearing in March 2013, in response to a question from Paul, Clinton stated she did not know whether the U.S. mission in Libya was procuring or transferring weapons to Turkey and other Arab countries.  Clinton further asked Paul to inquire with the “agency” that ran the CIA Annex in Benghazi for more information.

Clinton-linked group 'committed felony' - The attorney general of Georgia should open an investigation and file criminal charges against a group co-founded by former President Bill Clinton for holding a fundraising gala in Atlanta last March in which it raised $100,000 without being registered as a foundation in the state, as required by law, contends a Wall Street analyst who is probing the Clinton Foundation.  WND reported this week that Clinton serves as honorary chairman of the American India Foundation, which has fundraisers scheduled in Maryland, Virginia and Illinois without registering in those states as a non-profit with authority to raise tax-deductible charitable donations. Charles McCullough III finds himself accused of colluding with Republicans to destroy Clinton’s campaign. State Dept. breaks judge's deadline on Hillary emails - Hillary Clinton received a New Year’s Eve gift when the State Department broke a judge’s order to release a batch of emails from her tenure as secretary of state. Officials are blaming the holiday season for the State Department’s inability to release over 8,000 pages of emails on Thursday.  “We have worked diligently to come as close to the goal as possible, but with the large number of documents involved and the holiday schedule we have not met the goal this month,” the State Department said in a statement released Thursday.

Obama's remarks on Hillary emails anger FBI - The FBI may charge Hillary Clinton with “gross negligence” for her handling of classified information while secretary of state, but agents are saying the same thing about President Obama’s public comments on their ongoing investigation.  Officials in the agency are livid with Obama for throwing a rhetorical wrench into their nonpartisan fact-finding inquiry into the extra-governmental email server Clinton used during her tenure with the administration. They are trying to determine if Clinton violated certain sections of the Espionage Act.
“I don’t think it posed a national security problem,” Obama said Sunday on CBS’s “60 Minutes.

Feds release 7,800 pages of Clinton emails - The State Department released 7,800 pages of Hillary Clinton emails, including one marked “secret” that contained information about U.S. foreign relations.  The Hill noted that particular email spoke about the federal investigation of the 2012 attack on America’s compound in Benghazi, Libya, that left four Americans – including Ambassador Christopher Stevens – dead. The email was written in the wake of the arrest of suspects “who may” have been tied to the attack, the Hill said.

Hillary email scandal grows under blind media - Hours after select media outlets reported the cloud company Hillary Clinton hired to provide backup company service for her secretive home-based server system was turning over data to the FBI – and hours after one of her long-time aides was caught lying about email use – Hollywood long-timer James Woods took to Twitter to slam the “pathetic” press and demand: Why isn’t the mainstream covering this?

More bad news for Hillary: 'Highly likely' there's backup server - If Hillary Clinton deleted those emails in an effort to protect herself from prosecution, she may have made matters worse for herself. ABC News reports the company she hired to do cybersecurity work for says it is “highly likely” a full backup of the server was made and that thousands of emails she and her staff deleted may still exist.  Platte River Networks, the Denver-based firm, is now cooperating with the FBI’s investigation into the matter.  The FBI got involved after two emails recovered contained “top secret” information. Clinton had denied that classified information ever appeared on the server.  Barbara Wells, an attorney for Platte River, said the server was rendered blank after data was transferred from it in June 2013. But Wells also said data from Clinton’s old server was migrated to a new server that still exists.

'Secret' Iran nuke info in Hillary email - The State Department’s latest release of former Secretary Hillary Clinton’s emails show hundreds more than previously thought that wound through her home-based private server were labeled classified.  Up until Wednesday, authorities believed 185 emails were classified. The State Department then cleared another batch of emails for release to the public, and investigators shortly after found another 215 labeled classified.

Hillary emails nearly hacked by Russia - Hillary Clinton’s private email server she maintained in her home while serving as secretary of State was possibly hacked by Russia-tied authorities, and others, on five separate occasions.  Investigators discovered among Clinton’s cache of released emails five that contained malicious software aimed at transmitting data to three overseas computers, including at least one in Russia, the Associated Press reported. The malicious software was activated by clicking on it; it’s not clear if Clinton actually opened these messages or not, AP said.

New bombshell: 5-month gap in Hillary emails -  The FBI is investigating Clinton's use of the server and trying to retrieve 30,000 emails she deleted after her own staff deemed them personal correspondence.The State Department said it had received approximately "60,00-70,000 pages of email correspondence printed to paper and stored in twelve bankers boxes," which are "the only comprehensive set of Secretary Clinton's email correspondence."  But the department was concerned there were other Clinton emails that would not be found.

Clinton spokesman: 'I don't know what 'wiped' means' -   Former Secretary of State Hillary Clinton’s press secretary took a page out of his boss’ playbook on Thursday and played dumb when asked about her “wiped” server.  CNN’s Brianna Keilar tried for almost 10 minutes to get Brian Fallon to answer questions about the server Clinton turned over to the FBI on Aug. 11. “I don’t know what ‘wiped’ means,” Fallon said when asked about the server by Keilar, the Blaze reported.

Watergate reporter on Hillary email: 'Reminds me of Nixon tapes' -   The number of Hillary Clinton’s emails flagged for potential classified information has grown to 300 and now, in an ominous sign for her, one of the Washington Post’s famed Watergate reporters is drawing comparisons between her use of emails and President Richard Nixon’s use of audio tapes.  The number of flagged emails stands to grow exponentially if the secret information continues to be found at its present rate. FBI kicks off investigation of Hillary's email - The FBI has kicked off an investigation into the type of security Hillary Clinton used to safeguard the private email system she set up in her New York home while serving as secretary of state.   “Quite predictably, after the [intelligence community inspect general] made a referral to ensure that materials remain properly stored, the government is seeking assurance about the storage of those materials,” said David Kendall, Clinton’s attorney, in a statement reported by the Washington Post.

CNN debate host was on Clinton Global Initiative - Political pundits have wondered why CNN’s Chief Washington Correspondent, Jake Tapper, was not moderating Tuesday’s Democratic debate from Las Vegas, Nevada. They now may have an answer. The Clinton Global Initiative’s website lists CNN’s Anderson Cooper as a “notable past member.” A list of CGI members was published by Mediaite when ABC’s “This Week” moderator George Stephanopoulos failed to disclose his own ties to the foundation during an interview with “Clinton Cash” author Peter Schweizer on April 22. Stephanopoulos eventually apologized to viewers for not disclosing $75,000 in CGI donations. Cooper told the Huffington Post Oct. 7 there would be no “gotcha” questions during Tuesday nights Democratic debate. Drip, drip, drip: New Clinton Foundation scandal! - The embattled Clinton Foundation – accused of illegally enriching its namesakes and receiving politically infused donations from foreign nations and figures – is not registered as a charity in Ireland, even though the nonprofit has raised hundreds of millions of dollars in the island nation.   Ireland’s Charities Regulatory Authority stated in an email to Wall Street analyst Charles Ortel that its records show the Clinton Foundation under its various names, including the Clinton Health Access and the Clinton Global Initiative, is not registered as a charity in Ireland. Ortel who has been investigating the Clinton Foundation, as WND has reported, asked the CRA to confirm whether or not the Clinton Foundation or its subsidiaries are “validly registered within Ireland as charities.”
